Common use of CONSTRUCTION OF THE PROJECT/ APARTMENT Clause in Contracts

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the [Apartment/Plot] and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Madhya Pradesh Municipal Corporation Act, 1956, M.P. Bhoomi Vikas Niyam, 2012, Town and Country Planning Act, Panchyatraj Avem Gram Swaraj Adhiniyam, etc. and shall not have an option to make any variation /alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

Bhoomi Vikas Niyam, 2012, Town and Country Planning Act, Panchyatraj Avem Gram Swaraj Adhiniyam, etc. 2004 as amended time to time and shall not have an option to make any variation /alteration/ /alteration/modification in such plans, plans other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities specifications of the [Apartment/Plot] Unit and accepted the floor planPayment Plan, payment plan and the specifications, amenities and facilities [annexed plans,[annexed along with this Agreement] layout plans which has been approved by the competent authority, as represented by the Promoter. The Allottee has also understood that the building in which the Unit is situated forms part of the first phase of development. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilitiesspecifications as mentioned in PART-IX of Schedule A hereto. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and any modifications to be hereafter approved by the authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Madhya Pradesh West Bengal Municipal Corporation Act(Building) Rules, 1956, M.P. Bhoomi Vikas Niyam, 2012, Town and Country Planning Act, Panchyatraj Avem Gram Swaraj Adhiniyam, etc. 2007 & The West Bengal Municipal Act 1993 and shall not have an option to make any variation /alteration/ variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

Bhoomi Vikas Niyam, 2012, Town and Country Planning 2017 ( West Bengal Act, Panchyatraj Avem Gram Swaraj Adhiniyam, etc. XLI of 2017) and shall not have an option to make any variation /alteration/ /alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

Bhoomi Vikas Niyam, 2012, Town and Country Planning Act, Panchyatraj Avem Gram Swaraj Adhiniyam, etc. Panchayat (Colonyon ka Vikas) Niyam and shall not have an option to make any variation /alteration/ /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Madhya Pradesh Municipal Corporation Act, 1956, M.P. Bhoomi M.P Bhumi Vikas Niyam, 2012, Town and Country Planning Act, Panchyatraj Avem Xxxxx 2012 & Nagar Tatha Gram Swaraj Adhiniyam, etc. Nivesh Adhiniyam and shall not have an option to make any variation /alteration/ /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the AgreementAgreement & the allottee shall before entering in to the agreement shall satisfy himself about the compliance of construction.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The 7.1The Allottee has seen the proposed layout plan, and has independently made himself aware about the specifications, amenities and facilities of the [ApartmentAppartment/PlotPlot ] and accepted the floor plan, payment plan Payment Plan and the specifications, amenities and facilities [annexed , along with this Agreement] Agreement which has been approved by the competent authority, as represented by the PromoterPromoter and the Allottee is aware of the limitations, usage policies and maintenance of the installed items, fixtures and fittings. The Promoter shall develop the Project Project/Phase in accordance with the said layout plans, floor plans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Madhya Pradesh West Bengal Municipal Corporation Act, 1956, M.P. Bhoomi Vikas Niyam, 2012, Town and Country Planning Act, Panchyatraj Avem Gram Swaraj Adhiniyam, etc. 2006 and shall not have an option to make any variation /alteration/ / alteration / modification in such plansplans except rise in the floors , other than in the manner provided under the Act, Act and breach of this term by the Promoter shall constitute a material breach of the Agreement.
