Construction Disbursement Requisition Procedure. Appendix 6 sets forth milestone payments to be made with respect to each separate Initial Capital Improvement, and the sum of all such milestone payments equals the Fixed ICI D esign/ Build Price. Following the Commencement Date, the Lessee shall be entitled to submit Requisitions on a monthly basis and receive from the Lessor the milestone payments of the Fixed ICI Design/Build Price, which: (1) shall be m ade only upon com pletion of the milestone required to be completed as the basis for such payment as set forth in Appendix 6; (2 ) shall be subject to the maxim um paym ent limitations specified in the maximum drawdow n schedule set forth in Xxxxx xxx 6; and (3) shall be subject to the conditions of paym ent set forth in this Section . On the date that th e ICI Acceptance Date is permanently established under Section 11.7 the Lessee shall be entitled to receive all payments due for completed work which rem ain unpaid as of such date with respect to the applicable Initial Capital Improvement, except for the payment conditioned on Final Completion in the event Final Completion has not occurred prior to the ICI Acceptance D ate. The Fixed ICI Design/ Build Price Adjustm ents shall be payable monthly when and as the cost or expense constituting the Fixed ICI Design/Build Price Adjustment is paid or incurred.

  • Construction Phase Payments 10.3.1 Payments for Construction Phase Services shall be made as provided for in the UGSC and Owner’s Specifications. All payment requests shall be submitted through e- Builder® with a Schedule of Values and include all required attachments. Payment for approved Change Orders shall be made as part of Contractor’s Application for Payment. Failure to submit a Prime Contractor Progress Assessment Report form with each Application for Payment will cause rejection of the application by Owner and its return to Contractor.

  • Construction Phase Fee Contractor’s Construction Phase Fee is the maximum amount payable to Contractor for any cost or profit expectation incurred in the performance of the Work that is not specifically identified as being eligible for reimbursement by Owner elsewhere in this Agreement. References in the UGSC to Contractor’s “overhead” and “profit” mean Contractor’s Construction Phase Fee. The Construction Phase Fee includes, but is not limited to, the following items:

  • DIRECT CONSTRUCTION COST Direct Construction Cost means the sum of the amounts that Contractor actually and necessarily incurs constructing the Project in strict compliance with the Construction Documents. Direct Construction Cost includes only the cost categories set forth in this Article and does not include the Pre-Construction Phase Fees or the Construction Phase Fees unless specifically noted. References in the UGSC to adjustments in “cost” or “costs” mean the Direct Construction Cost.

  • Construction Work The regulation at 41 C.F.R. § 60-1.3 defines “construction work” as the construction, rehabilitation, alteration, conversion, extension, demolition or repair of buildings, highways, or other changes or improvements to real property, including facilities providing utility services. The term also includes the supervision, inspection, and other onsite functions incidental to the actual construction.

  • Drawings and Specifications at the Project Site The Contractor shall keep at the Site at least one copy of the Contract Documents and Change Orders, all in good order and available to the Design Professional and to his representatives.
