CITY'S OPTION TO TERMINATE. The Agreement may be terminated in accordance with the following provisions, which are not exclusive: Breach of Agreement. Administrative remedies - the City may terminate this Agreement due to a breach by Consultant. Termination for breach of Agreement will be without further compensation to the Consultant.
CITY'S OPTION TO TERMINATE. Lessee acknowledges and agrees that the parties have entered into this Lease Agreement for the purpose of providing a site for Lessee's recyclables trash container and that City may need to terminate the Lease Agreement and retake possession of the Enclosure to accommodate future public projects. Lessee further agrees that City shall have an option to terminate this Lease Agreement on the following conditions:
CITY'S OPTION TO TERMINATE. If for any reason the City fails to deliver possession of the Concession Space to Concessionaire within six (6) months after the Target Possession Date, then the City, in the sole and absolute discretion of the Manager, shall have the option at any time thereafter to notify Concessionaire in writing of the City's intent to terminate the Agreement. In such event, the Agreement shall terminate on the date as stated in said notice, and both the City and Concessionaire shall be released from any liability or obligation under the Agreement.
CITY'S OPTION TO TERMINATE. Notwithstanding anything contained in Section 7.01 above to the contrary, if at any time or from time to time during the term of this Use Agreement, COTC desires to assign this Use Agreement or subject all of the Premises to a sub-use agreement, COTC shall first notify City in writing of the proposed terms and conditions of the assignment or sub-use. Upon receipt of such notice or upon City becoming aware of an assignment or sub-use, if no such notice is given before it occurs, City shall have the option to terminate this Use Agreement for the Premises. Such option shall be exercisable by City in writing for a period of thirty (30) days after receipt of COTC's notice of intent to assign or subject the Premises to a sub-use agreement or at any time after an assignment or sub-use without such prior notice. If City elects to terminate this Use Agreement with respect to the Premises, this Use Agreement shall terminate with respect to the Premises on the date set forth in such notice from City which is not more than thirty (30) days following City's notice of the exercise of City's option. The parties shall thereafter enter into an Amendment to this Use Agreement evidencing such termination, but failure to enter into such Amendment shall not affect the preceding. If City fails to exercise such option, and COTC fails to complete the assignment or Sub- Use Agreement with the third party set forth in COTC's notice to City within sixty (60) days thereafter in accordance with the terms of COTC's notice to City, COTC shall again comply with all the conditions of this Article VII as if the notice and option hereinabove referred to had not been given and received.
