California Professional Engineers Act Sample Clauses

California Professional Engineers Act. The Contractor shall specifically be responsible for providing licensed professional engineering services necessary to meet the requirements of the Professional Engineers Act (Business and Professions Code Sections 6700-6799). The Authority does not intend to contract for, pay for, or receive any design services which are in violation of any professional licensing laws, and by execution of the Contract, the Contractor acknowledges that the Authority has no such intent. The Contractor is fully responsible for furnishing the design of the Project, although the fully licensed design firms or individuals will perform the design services required by the Contract Documents. Any references in the Contract Documents to the Contractor's responsibilities or obligations to "perform" the design portions of the Work shall be deemed to mean that the Contractor shall "furnish" the design for the Project. The terms and provisions of this clause shall control and supersede every other provision of all Contract Documents.
