Butadiene. Pursuant to an agreement dated September 11, 1999, Shell, through a local operating subsidiary, supplies, and we purchase, a nominated volume of butadiene per year for our manufacturing facility in the U.S. We purchased approximately 51,000 and 55,000 metric tons of butadiene pursuant to this agreement in 2001 and 2002, respectively. Pursuant to agreements dated July 1, 1999 and December 1, 1999, we purchase a minimum of 18,000 and 30,000 metric tons, and Shell supplies a maximum of 40,000 and 47,000 metric tons, of butadiene per year for our manufacturing facilities in France and Germany, respectively. The agreed annual quantities are subject to increase or decrease upon annual review by the parties. The initial terms for the supply arrangements in the U.S., France, and Germany end December 31, 2005, December 31, 2007, and December 31, 2040, respectively. Each contract will automatically renew indefinitely subject to 12, 24, and 60 months prior written notice of termination in the U.S., France, and Germany, respectively. In both the U.S. and Europe, Shell charges a price based on published market prices for butadiene. In the U.S., however, if we can provide satisfactory evidence of available butadiene, in certain minimum quantities during a one-year period, of like quality produced in the U.S. at a lower price under similar terms and conditions and Shell chooses not to match this lower price, we may deduct all quantities so purchased from the remaining applicable annual quantity.
Butadiene. The specifications applicable to Product supplied from Seller owned facilities and non-Seller owned facilities under this Contract are provided in Attachment 1A (“Specifications of Product supplied from Seller owned facilities”) and Attachment 1B (“Specifications of Product supplied from non-Seller owned facilities”) CONFIDENTIAL TREATMENT REQUESTED WITH RESPECT TO CERTAIN PORTIONS HEREOF DENOTED WITH “***” respectively, and are only applicable at time of loading the barge or rail car at Seller’s facility or mutually agreed alternate facility and are made part of the Contract.
Butadiene. (C) SELLER is willing to supply 1,3 Butadiene to PURCHASER subject to Seller´s 1,3-Butadiene plant availability and PURCHASER is willing to purchase and take delivery of 1,3 Butadiene from SELLER on the terms and conditions set out in this Agreement. IT IS AGREED as follows:
Butadiene. (C) SELLER is willing to supply 1,3 Butadiene to PURCHASER subject to SELLER´s 1,3-Butadiene plant availability and PURCHASER is willing to purchase and take delivery of 1,3 Butadiene from SELLER on the terms and conditions set out in this Agreement which amends and restates the agreement between SELLER and PURCHASER for the supply of 1,3 Butadiene dated 1 January 2012 (the “Original Supply Agreement”) with effect from 1 January 2017.   • Gas If Customer has selected a Gas Fixed Rate, Customer’s Price will be based on the Fixed Rate(s), plus the Administration Charge, set forth in the Application, which includes RITERATE ENERGY’s compressor fuel and transportation charges, administrative and transaction costs and the Gas Balancing Amount and any Regulatory Charges (defined below).

  • DISTURBANCES Tenant and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the agreed upon number people, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts which interferes with neighbors' right to quiet enjoyment of their premises. HOLD HARMLESS iTrip or the Owner, does not assume any liability for loss, damage or injury to persons or their personal property. Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, electricity or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond its control. BALCONY / TERRACE Tenant hereby acknowledges that the unit they have reserved may include a balcony and/or terrace, which can be dangerous areas. That these areas can become slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the balcony areas. DECK / POOL / BEACH Tenant hereby acknowledges that the property they have reserved includes a deck, pool and beach, which can be dangerous areas. The deck can become slippery when wet, and injury and drowning may occur to anyone who is not careful around the pool, beach and deck. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the deck & pool. MAINTENANCE Please report any maintenance needs to the front desk. All maintenance needs will be addressed immediately by our maintenance crew available 24/7. Refunds will not be made for maintenance issues including, but not limited to heating and air conditioning, pest control, appliances, televisions, and stereos.

  • Transport 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to EZ Phone for the provision of a qualifying service, as set forth herein.

  • Fuel 28.1 The Vehicle must be returned with the amount of fuel equal to that at the time of the commencement of the rental. If the Vehicle is returned with less fuel, the difference will be charged to You at a rate of $5.00 including GST per litre (which includes a service component).

  • Natural Gas 21.1 Subject to Article 21.2, the Indian domestic market shall have the first call on the utilisation of Natural Gas discovered and produced from the Contract Area. Accordingly, any proposal by the Contractor relating to Discovery and production of Natural Gas from the Contract Area shall be made in the context of the Government’s policy for the utilisation of Natural Gas and shall take into account the objectives of the Government to develop its resources in the most efficient manner and to promote conservation measures.

  • Disturbance Analysis Data Exchange The Parties will cooperate with one another and the NYISO in the analysis of disturbances to either the Large Generating Facility or the New York State Transmission System by gathering and providing access to any information relating to any disturbance, including information from disturbance recording equipment, protective relay targets, breaker operations and sequence of events records, and any disturbance information required by Good Utility Practice.

  • SLEEPING CAPACITY/DISTURBANCES Tenant and all other occupants of the premises will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the sleeping capacity of the property, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts that interfere with neighbors' right to quiet enjoyment of their premises. HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) loss, damage, illness, injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved include a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

  • Products Products available under this Contract are limited to Software, including Software as a Service, products and related products as specified in Appendix C, Pricing Index. Vendor may incorporate changes to their product offering; however, any changes must be within the scope of products awarded based on the posting described in Section 1.B above. Vendor may not add a manufacturer’s product line which was not included in the Vendor’s response to the solicitation described in Section 1.B above.
