Authority to act on behalf of Concessionaire. 36.2.1 During the period of Suspension, the Authority shall, on behalf of the Concessionaire, collect all Fee and revenues under and in accordance with this Agreement and deposit the same in the Escrow Account. The Authority shall be entitled to make withdrawals from the Escrow Account for meeting the costs incurred by it for remedying and rectifying the cause of Suspension, and thereafter for defraying the expenses specified in Clause 31.3.
Authority to act on behalf of Concessionaire. 31.2.1 During the period of Suspension hereunder, all assets and liabilities in relation to the Project shall continue to vest in the Concessionaire and all things done or actions taken, including expenditure incurred by the Authority for discharging the obligations of the Concessionaire under and in accordance with this Agreement and the Project Agreements, shall be deemed to have been done or taken for and on behalf of the Concessionaire and the Concessionaire undertakes to indemnify the Authority for all costs incurred during such period.
Authority to act on behalf of Concessionaire. (a) During the period of Suspension, the Authority shall, on behalf of the Concessionaire, collect all Fee and revenues under and in accordance with this Agreement. The Authority shall be entitled to use the Fee collected in accordance with this Clause 32.2 (a) for meeting the costs incurred by it for remedying and rectifying the cause of Suspension.
Authority to act on behalf of Concessionaire. 24.2.1 During the period of Suspension, the Concessionaire shall continue to perform its obligations pertaining to delivery of Medical Services to patients under this Agreement and bear all the costs for remedying and rectifying the cause of Suspension and Operation and Maintenance of the Diagnostic centres.
Authority to act on behalf of Concessionaire. 23.2.1 During the period of Suspension, the Authority shall, on behalf of the Concessionaire, be entitled to make withdrawals from the Escrow Account for meeting the Construction expenses and for meeting the costs incurred by it for remedying and rectifying the cause of Suspension, and thereafter for defraying the expenses specified in Clause 20.3. For the avoidance of doubt, in the event of Suspension during the Defect Liability Period, the Authority shall continue to make the Annuity Payments under and in accordance with this Agreement and deposit the same in the Escrow Account.
Authority to act on behalf of Concessionaire. 25.2.1 During the period of Suspension hereunder, all assets and liabilities in relation to the Project shall continue to vest in the Concessionaire and all things done or actions taken, including expenditure incurred by the Authority for discharging the obligations of the Concessionaire under and in accordance with this Agreement and the Project Agreements, shall be deemed to have been done or taken for and on behalf of the Concessionaire and the Concessionaire undertakes to indemnify the Authority for all costs incurred during such period. The Concessionaire hereby licenses and sub-licenses respectively, the Authority or any other person authorised by it under this Article to use during Suspension, all intellectual property belonging to or licensed to the Concessionaire.
Authority to act on behalf of Concessionaire. 36.2.1 During the period of Suspension, the Authority shall, on behalf of the Concessionaire, operate and maintain the Project Highway under and in accordance with this Agreement. The Authority shall be entitled to make withdrawals from the Escrow Account for meeting the costs incurred by it for remedying and rectifying the cause of Suspension, and thereafter for defraying the expenses specified in Clause 31.3.
Authority to act on behalf of Concessionaire. 31.2.1. During the period of Suspension, the Authority shall, on behalf of the Concessionaire, operate and maintain the Storage Facility under and in accordance with this Agreement and appropriate the same for meeting the O&M Expenses and for remedying and rectifying the cause of Suspension. Any balance remaining after meeting the aforesaid expenditure shall be deposited in a bank account to be designated by the Concessionaire. For the avoidance of doubt, the Authority shall continue to pay the Fixed Storage Charge, Variable Charges and Bag Handling Charges under and in accordance with this Agreement and deposit the same in the aforesaid designated bank account after appropriating the expenses and costs specified hereinabove
Authority to act on behalf of Concessionaire. 28.2.1 During the period of Suspension, the Authority shall withhold all Tipping Fee payments to the Concessionaire. The Tipping Fee shall be deposited by the Authority in a separate bank account. The Authority shall be entitled to make withdrawals from this account for meeting the costs incurred by it for remedying and rectifying the cause of Suspension, and thereafter for defraying the expenses.
Authority to act on behalf of Concessionaire. 11A.2.1 During the period of Suspension, the AMC shall be entitled to make withdrawals from the Escrow Account for meeting the costs incurred by it for discharging the Concessionaire’s obligations.
