ANd RESIGNATION. (1) Employees shall be subject to disciplinary action, includ- ing discharge, for just cause provided that the employee knew or reasonably should have known that his/her con- duct could lead to disciplinary action. Where the Author- ity has promulgated written rules, no disciplinary action may be taken against an employee unless the rules have been provided, in advance, to the Local Union and pub- lished for employees subject to them. The Authority recognizes that employees have the right to privacy and any adverse action taken against an employee for off-duty conduct shall take into account the employee’s right to privacy and the impact of employee misconduct on job performance, job site safety, the Authority’s reputation or other legitimate employment related factors.
