By using E-Banking Services, you acknowledge and agree that this Agreement sets forth security procedures for electronic banking transactions, which are commercially reasonable. You agree to be bound by our instructions which we implement in compliance with these procedures, unless you have given us prior notice of possible unauthorized use as described above (and we had a reasonable opportunity to act on such notice).

You agree to be bound by instructions, whether authorized or unauthorized, which we implement in furtherance of these procedures.

You agree to be bound by instructions, whether authorized or unauthorized, which we implement in compliance with these procedures, unless you have given us prior notice of possible unauthorized use (and we had a reasonable opportunity to act on such notice). In addition to our security controls, the bank strongly recommends that you take an active part in preventing and mitigating your risk of online fraud by implementing additional recommended security controls. BAC shall from time to time establish one or more security procedures to be used by BAC and you in connection with certain services. You agree to be bound by any payment order, transaction or Service change order that is acted upon by BAC in accordance with such security procedures. You understand that the security procedures are not for the purpose of detecting errors in the transmission or content of information controlled by you. If you select certain security procedures to use in connection with a Service and those security procedures provide less protection against unauthorized transactions or activity than other security procedures offered by BAC in connection with such Service: (i) the security procedures selected by you shall be deemed commercially reasonable to the same extent as the security procedures offered by BAC that provide greater protection;, and (ii) you shall indemnify and hold BAC harmless from and against all Losses and Liabilities relating directly or indirectly to your use of such security procedures. BAC reserves the right to issue new security procedures and/or to cancel or change any security procedures from time to time.

If you do not change your access code on a regular basis, you agree that the security procedure you have chosen is a commercially reasonable security procedure.
