State Future Response Costs definition

State Future Response Costs means all costs, including direct and indirect costs, including but not limited to State employee salary and benefit costs, and travel expenses, that State employees incur in reviewing plans, reports, or other items pursuant to this CD, verifying Work, consulting with and providing comments to EPA and SD in connection with the Work, or otherwise implementing, overseeing, or enforcing this CD; and any costs spent on removal of one or more portions of the Trowbridge Dam structure done prior to SD’s Area 4 Removal Work.
State Future Response Costs means all costs, including direct and indirect costs, that the State incurs after the Effective Date, which are not inconsistent with the NCP, in reviewing or developing plans, reports and other items pursuant to this Consent Decree, verifying the Work, or otherwise implementing, overseeing, or enforcing this Consent Decree, including, but not limited to, payroll costs, contractor costs, travel costs, laboratory costs, and the costs incurred pursuant to Sections VII and IX (Remedy Review and Access and Institutional Controls) (including, but not limited to, the cost of attorney time and any monies paid to secure access and/or to secure or implement Institutional Controls including, but not limited to, the amount of just compensation), Section XV (Emergency Response), and Paragraph 113 (Work Takeover).

State Future Response Costs means all costs, including, but not limited to, direct and indirect costs, that the State incurs in reviewing or developing plans, reports, and other deliverables submitted pursuant to this CD, in overseeing implementation of the Work, or otherwise implementing, overseeing, or enforcing this CD, including, but not limited to, payroll costs, contractor costs, travel costs, laboratory costs, the costs incurred pursuant to Paragraph 23 (Notice to Successors-in-Title), Sections VII (Remedy Review), VIII (Property Requirements) (including, but not limited to, the cost of attorney time and any monies paid to secure access and/or to secure, implement, monitor, maintain, or enforce Institutional Controls including, but not limited to, the amount of just compensation), and Paragraph 11 (Emergencies and Releases), Paragraph 31 (Access to Financial Assurance), and Paragraph 12 (Community Involvement).
