Public Benefit Improvements definition

Public Benefit Improvements shall have the meaning assigned to such term in Section 9 of this Agreement.
Public Benefit Improvements mean the improvements to the Park Project in excess of the Baseline Park, including resiliency improvements, enhancements to the Baywalk and Xxxxx Road and art within the Park Project and the Commercial Retail Project in excess of the requirements of AIPP, as described on Exhibit “H” attached hereto, having an aggregate cost for design, construction, permitting and fees of not less than $5,000,000 (provided, however, in no event shall Developer be obligated to expend more than $5,000,000 in the aggregate in connection with the Public Benefit Improvements, including hard and soft costs in connection with the development, construction and completion thereof).

Examples of Public Benefit Improvements in a sentence

  • The PEDB may require a bond to cover the cost of any Public Benefit Improvements that will be constructed, or a binding agreement approved by Town Counsel, to remain in place until the improvements are completed to the satisfaction of the Town.

  • If sufficient Public Benefit Improvements are made, the PEDB shall make a written finding that the applicant will provide significant improvements providing a public benefit, in addition to those improvements necessary to meet the base density requirements of this bylaw.

  • A specific time frame for the completion of all required off-site Public Benefit Improvements shall be incorporated as a condition of approval of the PEDB.

  • The applicant shall provide a list of all permits and approvals required relating to any proposed Public Benefit Improvements with the application.

  • The offer and commitment by an applicant to provide all or any number of Public Benefit Improvements does not, in and of itself, require the PEDB to grant such density bonus.

  • All Public Benefit Improvements used for the density bonus shall require approval by the Planning Board which will consider recommendations made by the Town of Norwood Board of Selectmen, Department of Public Works, Board of Health, Conservation Commission, Community Preservation Committee, Historical Commission, and other boards and committees as applicable.

  • If sufficient Public Benefit Improvements are made, the Planning Board shall make a written finding that the applicant will provide significant improvements providing a public benefit, in addition to improvements required to achieve the base density allowed in this bylaw.

  • The application shall also be subject to the requirement for approval of Public Benefit Improvements under Section 9.4.12.2.c.9.4.16 Special Permit for Design Waiver1.

  • The Planning Board by Special Permit may allow higher density up to the maximum established on Table 3 above if certain Public Benefit Improvements are made by the applicant that provide benefits to residents and businesses in the Development Site as well as to the MUOD, and surrounding area.

  • The PEDB may, by special permit, allow higher density up to the maximum established on Table 9.8.A above if certain Public Benefit Improvements are made by the applicant that provide benefits to residents and businesses in the Development Tract, the Oak Grove Park Districts, and surrounding area.

Related to Public Benefit Improvements

  • Joint Improvements means Improvements the inventors of which are jointly (a) employees of, or others obligated to assign inventions to, ImmunoGen or any Affiliate of ImmunoGen, and (b) employees of, or others obligated to assign inventions to, Lilly or any Affiliate of Lilly.

  • Private Improvements means the improvements to be constructed on the Property that are not Public Improvements.

  • Improvement Plan means the plan required by the Authority from the Supplier which shall detail how the Supplier will improve the provision of the Goods and/or Services pursuant to Clause 29.1.1 (Authority Remedies);

  • Disabled parking license plate means a license plate that displays the international symbol of access

  • Minimum Improvements means the acquisition of land and construction of a 64-unit market rate residential apartment building and related improvements. The Minimum Improvements are more fully depicted in Exhibit B, which is attached hereto and incorporated herein.

  • Community Developmental Disability Program (CDDP means an entity that is responsible for planning and delivery of services for individuals with developmental disabilities in a specific geographic service area of the state operated by or under a contract with the Division or a local mental health authority.

  • Infrastructure Improvements means a street, road, sidewalk, parking facility, pedestrian mall, alley, bridge, sewer, sewage treatment plant, property designed to reduce, eliminate, or prevent the spread of identified soil or groundwater contamination, drainage system, waterway, waterline, water storage facility, rail line, utility line or pipeline, transit-oriented development, transit-oriented property, or other similar or related structure or improvement, together with necessary easements for the structure or improvement, owned or used by a public agency or functionally connected to similar or supporting property owned or used by a public agency, or designed and dedicated to use by, for the benefit of, or for the protection of the health, welfare, or safety of the public generally, whether or not used by a single business entity, provided that any road, street, or bridge shall be continuously open to public access and that other property shall be located in public easements or rights-of-way and sized to accommodate reasonably foreseeable development of eligible property in adjoining areas. Infrastructure improvements also include 1 or more of the following whether publicly or privately owned or operated or located on public or private property:

  • Basic health benefit plan means any plan offered to an individual, a small group,

  • Continuous Improvement Plan means a plan for improving the provision of the Goods and/or Services and/or reducing the Charges produced by the Supplier pursuant to Framework Schedule 12 (Continuous Improvement and Benchmarking);

  • Project Improvements means site improvements and facilities that are:

  • Home improvement means the remodeling, altering,

  • Infrastructure improvement means permanent infrastructure that is essential for the public health and safety or that:

  • Improvement Fund means the Improvement Fund for General Obligation Temporary Notes, Series 2017-1 created pursuant to Section 501 hereof.

  • Adopt a comprehensive land use plan means to enact a new

  • Site Improvements means any construction work on, or improvement to, streets, roads, parking facilities, sidewalks, drainage structures and utilities.

  • Public Improvements means only the following improvements: housing facilities; garbage disposal plants; rubbish disposal plants; incinerators; transportation systems, including plants, works, instrumentalities, and properties used or useful in connection with those systems; sewage disposal systems, including sanitary sewers, combined sanitary and storm sewers, plants, works, instrumentalities, and properties used or useful in connection with the collection, treatment, or disposal of sewage or industrial wastes; storm water systems, including storm sewers, plants, works, instrumentalities, and properties used or useful in connection with the collection, treatment, or disposal of storm water; water supply systems, including plants, works, instrumentalities, and properties used or useful in connection with obtaining a water supply, the treatment of water, or the distribution of water; utility systems for supplying light, heat, or power, including plants, works, instrumentalities, and properties used or useful in connection with those systems; approved cable television systems, approved cable communication systems, or telephone systems, including plants, works,

  • Energy efficiency improvement means equipment, devices, or materials intended to decrease energy consumption, including, but not limited to, all of the following:

  • contributory employment and support allowance means an allowance under Part 1 of the Welfare Reform Act 2007 as amended by the provisions of Schedule 3, and Part 1 of Schedule 14, to the Welfare Reform Act 2012 that remove references to an income-related allowance and a contributory allowance under Part 1 of the Welfare Reform Act 2007 as that Part has effect apart from those provisions;

  • Substitute Improvements means the substitute or additional improvements of the Issuer described in Article V hereof.

  • Public improvement costs means the costs of:

  • Autism spectrum disorders means any of the pervasive developmental disorders as defined by the Diagnostic and Statistical Manual of Mental Disorders, 4th edition, published by the American Psychiatric Association, including autistic disorder, Asperger's disorder and pervasive developmental disorder not otherwise specified.[PL 2011, c. 420, Pt. A, §26 (RAL).]

  • Best available control technology (BACT means an emissions limitation (including a visible emission standard) based on the maximum degree of reduction for each pollutant subject to regulation under CAA which would be emitted from any proposed major stationary source or major modification which the Department, on a case-by-case basis, takes into account energy, environmental, and economic impacts and other costs, determines is achievable for such source or modification through application of production processes or available methods, systems, and techniques, including fuel cleaning or treatment or innovative fuel combustion techniques for control of such pollutant. In no event shall application of best available control technology result in emissions of any pollutant which would exceed the emissions allowed by any applicable standard under 7 DE Admin. Code 1120 and 1121. If the Department determines that technological or economic limitations on the application of measurement methodology to a particular emissions unit would make the imposition of an emissions standard infeasible, a design, equipment, work practice, operational standard, or combination thereof, may be prescribed instead to satisfy the requirement for the application of best available control technology. Such standard shall, to the degree possible, set forth the emissions reduction achievable by implementation of such design, equipment, work practice or operation, and shall provide for compliance by means which achieve equivalent results.

  • income-related employment and support allowance means an income-related allowance under Part 1 of the Welfare Reform Act 2007;

  • Maximum medical improvement means that no further material improvement would reasonably be expected from medical treatment or the passage of time;

  • Tenant Improvements Defined in Exhibit B, if any.

  • main phase employment and support allowance means an employment and support allowance where the calculation of the amount payable in respect of the applicant includes a component under section 2(1)(b) or 4(2)(b) of the Welfare Reform Act 2007 except in Part 1 of Schedule 1;
