NPAs definition

NPAs means that certain Master Note Purchase Agreement, dated as of December 13, 2010 between the Company and the holders from time to time of the notes issued thereunder, as in effect on December 20, 2017, as amended by that certain First Amendment to Master Note Purchase Agreement, dated as of August 19, 2011, as further amended by that certain Second Amendment to Master Note Purchase Agreement, dated as of December 28, 2016 and as supplemented by that certain First Supplement to Note Purchase Agreement dated as of December 19, 2013, as amended by that certain First Amendment to First Supplement to Note Purchase Agreement dated as of February 24, 2014 and that certain Master Note Purchase Agreement entered into as of the date hereof or as either may be modified hereafter without breach of the provisions of this Agreement and such other Master Note Purchase Agreement as may hereafter be made by the Company and the holders from time to time of the notes issued thereunder on substantially the same terms as the initial NPAs or supplement thereto as may be made by the Company with respect to additional Private Placement Indebtedness issued after the date hereof not to exceed Two Hundred Million Dollars ($200,000,000) as the same may thereafter be modified thereafter without breach of the provisions of this Agreement.
NPAs means (i) all loans (excluding the guaranteed portion of any loan that is partially guaranteed by the U.S. Small Business Administration) and leases (A) that are contractually past due 90 days or more in the payment of principal and/or interest, (B) that are on nonaccrual status, (C) where a reasonable doubt exists, in the reasonable judgment of Seller, as to the timely future collectibility of principal and/or interest, whether or not interest is still accruing or the loan is less than 90 days past due, (D) where the interest rate terms have been reduced and/or the maturity dates have been extended subsequent to the agreement under which the loan was originally created due to concerns regarding the borrower’s ability to pay in accordance with such initial terms, (E) where a specific reserve allocation exists in connection therewith or (F) that have been classified “Doubtful,” “Loss” or the equivalent thereof by any Governmental Entity, and (ii) all DPC Property.
NPAs has the meaning specified in the recitals to this Agreement.

More Definitions of NPAs

NPAs means (a) this Agreement and (b) each other note purchase agreement between the Company and the holder of Prior Notes, providing for the exchange of such Prior Notes to the extent set forth therein.
NPAs or “natural Protected Areas system” means all areas considered as Protected Areas (as hereinafter defined), including Mangroves;
NPAs the National Police Air Service which shall provide the services in relation to this Agreement which are delegated to the Lead Local Policing Body, including those set out in Schedule 1.
NPAs means, the Borrower’s National Protected Areas System or Sistema Nacional de Áreas Protegidas, established pursuant to Ley 41 of the Borrower, dated July 1, 1998, as described and regulated in ANAM Resolution No. JD-09- 94 of June 29, 1994 as amended to date.

  • Channel migration zone (CMZ) means the area where the active channel of a stream is prone to move and this results in a potential near-term loss of riparian function and associated habitat adjacent to the stream, except as modified by a permanent levee or dike. For this purpose, near-term means the time scale required to grow a mature forest. (See board manual section 2 for descriptions and illustrations of CMZs and delineation guidelines.)
