Limited Common Property definition

Limited Common Property means common property designated for the exclusive use of the owners of one or more strata lots.

In addition, the Company may demonstrate its intent to constitute any other part of ACHASTA as Limited Common Property in a deed or other instrument of conveyance to or other agreement with the Association or by identifying any portion of the property as Limited Common Property on any plat of survey recorded in Lumpkin County, Georgia, or by such other means as clearly reflect the character of any such property to be Limited Common Property. Provided,however, that the interpretation of what is or is not Limited Common Property shall be strictly construed and, except as provided herein no Limited Common Property shall arise by virtue of implication and all Limited Common Property shall be specifically designated as such by the Company. Notwithstanding anything in this Amended and Restated Declaration to the contrary, any road constructed by the Company within a Limited Common Property and associated appurtenances as determined by Company shall automatically be deemed “Common Property” and no further act or evidence of intenton the part of the Company shall be required.
