At the end of the calendar year, the Settlement Claims Administrator will issue each Participating Collective Member who has cashed a check an IRS Form W-2 for that portion of the Participating Collective Member’s settlement payment which is being treated as wages, and an IRS Form 1099 for the portion of the Participating Collective Member’s settlement payment which is being treated as liquidated damages, penalties, and interest.
Any Class Member who is not also a Named Plaintiff, including any Class Member who is also an FLSA Collective Member, may exclude themselves from the settlement as set forth herein.
At any point in the Initial Check Cashing Period, the Administrator shall have the authority to stop payment on a lost Settlement Payment check and issue a new one to a requesting Settlement Collective Member or Participating Class Member, and the Parties agree that all costs associated with doing so shall be paid from the Net Settlement Amount.

Settlement payments will be calculated for each Qualified State Law Class Member who does not Opt Out in the manner prescribed in Section 3.6 and FLSA Collective Member.
All legal establishments comprising a Collective Member are required to sign the subscription to the Statutes.
Their term of office is terminated if the subsequent General Meeting fails to ratify their appointment, in which case the concerned Collective Member must appoint another person, subject to the ratification process.
This Settlement is intended to include in its effect all wage and hour claims identified in this Section 3.8(B), including claims that each FLSA Collective Member does not know or suspect to exist in his or her favor against Defendants or Releases at the time of the release.
Individuals who contact the Claims Administrator who are neither an FLSA Collective Member, a State Law Class Member, nor an individual with a claim of being a State Law Class Member will be read a script by the Claims Administrator as agreed by and between the Parties which explains that, according to the Claims Administrator’s information, they are not part of the Settlement.
