Participating Claimants definition

Participating Claimants means and refers to members of the Settlement Class who submit timely, complete, and valid Claim Forms and who are determined by the Settlement Administrator to be eligible for benefits under this Agreement.

Participating Claimants as used in this Agreement shall refer to those persons or derivative claimants who are claiming an injury due to the use of Zyprexa and whose cases and claims are subject to the terms of this Agreement. A final list of Participating Claimants has been provided to Lilly. This list contains confidential and private information regarding each individual claimant and, as such, will be kept by Lilly, the trustee for the Participating Law Firms and the Special Settlement Masters in a separate file as an addendum to this Agreement.
