Zoning Changes. Owner shall notify DEQ no less than thirty (30) days before Owner’s petitioning for or filing of any document initiating a rezoning of the Property that would change the base zone of the Property under the Xxxxxxx County zoning code or any successor code. As of the date of this Easement and Equitable Servitudes, the base zone of the Property is Commercial – Community [CC].
Zoning Changes. Initiate, approve or acquiesce to any change in or modification to the zoning in effect for the Project Site or any portion thereof without the prior written consent of the Director. The Company shall promptly notify the Director of any such proposed change or modification stating in reasonable detail the anticipated or proposed change and the manner in which such change would affect the Company’s use and enjoyment of the Project Site, or any part thereof. As of the date of this EES, the base zone of the Property is Moderate Residential (R7).
Zoning Changes. The zoning designation of individual properties is subject to change during the term of this Agreement. In the event that a property changes its zoning designation to a non-Industrial use, Contractor must provide the customer notice that Contractor will discontinue service within thirty (30) days of notice. Customer will be required to subscribe to services provided by the approved Collector for properties in the Exclusive Franchise Area. The terms of this Agreement supercede all terms in an agreement between Contractor and customers.
