Voluntarily Admits Violation of Program Conditions. If the employee was originally referred to the program as a result of a disciplinary action taken as provided in Section 4 above, and the employee voluntarily admits to violation of any of the original or subsequent conditions set forth in the program agreement, the SAP shall provide the Chief of Police, the employee and his/her representative with recommendations for remedial treatment or other appropriate action. The remedial treatment may consist of additional outpatient or inpatient treatment. The Chief of Police shall review the disciplinary penalty being held in abeyance and may implement the penalty in full or in part, or take other action that the Village deems necessary. If the employee is permitted to undergo additional inpatient treatment, the employee shall use his/her unused personal leave, compensatory time, holidays and vacation, in that order, until all of the foregoing is exhausted. Upon exhaustion of all leave time balances, the employee shall then be placed on sick leave pursuant to Article 14-

Charges will accrue only after prior written authorization certified by the Controller, and the amount of City’s obligation hereunder shall not at any time exceed the amount certified for the purpose and period stated in such advance authorization. This Agreement will terminate without penalty, liability or expense of any kind to City at the end of any fiscal year if funds are not appropriated for the next succeeding fiscal year.
