Use of Over. The-Counter or Prescribed Legal Drugs No Employee shall be subject to discipline for the recommended use of over-the- counter or the prescribed use of legal drugs for the treatment of illness or injury. However, if the Employee knows or should know that use of an over-the-counter or prescribed drug does or could impair the Employee's ability to perform the Employee’s job duties or operate an Employer vehicle or equipment, the Employee shall promptly notify the Employee’s immediate Supervisor.

Use of Over the-Counter Medications: The uses of over-the-counter medications are in no way prohibited. An employee who ingests an over-the-counter medication in doses that may affect the employee’s ability to safely perform assigned duties must report the use of the over- the-counter medication to the employee’s supervisor. The decision, once informed by the employee as to whether or not the employee works the employee's assigned duties shall be the responsibility of the employee’s supervisor. There will be no discipline to an employee who, prior to working, reports to the employee’s supervisor the use of an over-the-counter medication which the employee feels may affect the employee’s assigned duties. Failure to report the use of an over-the-counter medication which the employee feels may affect the employee's ability to safely perform the employee’s duties, may subject the employee to disciplinary action. Ingestion of over-the-counter medication which repeatedly renders an employee unfit for duty may subject the employee to disciplinary action.
