Common use of Transfers Outside Bargaining Unit Clause in Contracts

Transfers Outside Bargaining Unit. An employee voluntarily transferred to a position outside of the bargaining unit shall not accumulate seniority during such period of employment outside the bargaining unit. Such employee will, however, be entitled to retain his original seniority (less time spent outside the bargaining unit) in the event of transfer back into the bargaining unit within one year immediately following transfer to the outside position. An employee transferring back to the bargaining unit will be transferred to the Sweeper job classification.

Such employee will, however, be entitled to retain his original seniority (less time spent outside unit if the bargaining unit) in the event assignment is for a period of transfer back into the bargaining unit within one 1 year immediately following transfer to the outside positionor less. An employee transferring back to the bargaining unit will be transferred to the Sweeper Utility job classification.
