The "Transfers Outside Bargaining Unit" clause defines the rules and procedures for moving employees from positions covered by the bargaining unit to roles that fall outside its scope. Transfers Outside Bargaining Unit. No employee shall be transferred to a position outside the Bargaining Unit without his/her consent. An employee who consents to transfer, for any reason, to a position which he knows to be outside the Bargaining Unit shall not then initiate proceedings to have that position included in the Bargaining Unit.
Transfers Outside Bargaining Unit. Employees, who transfer out of the Bargaining Unit, after the effective date of this Contract, cease to have any Bargaining Unit seniority thirty (30) calendar days after such transfer. If such employee so wishes, he may return to the Bargaining Unit within this thirty (30) day period without loss of seniority.
Transfers Outside Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without their consent. In the case where an employee is transferred outside the bargaining unit and they return to the bargaining unit, they shall be placed in their original job.
(a) In cases of promotions or transfers, seniority shall prevail provided the employee(s) can fill the normal requirements of the position. Promotion is hereby defined as a move from a lower classification to a higher classification. Both parties recognize the principle of promotion within the service of the Employer and that job opportunity should increase in proportion to length of service. When the successful applicant is an internal applicant, the appointment shall be made within thirty (30) days of the closing of the posting. Where the Employer finds that it is not possible to make the appointment within thirty (30) days, they will consult with the Union. It is understood that, with respect to positions covered by the CSU Collective Agreement, members of this bargaining unit shall be subject to the provisions of Article 11.08 of that agreement.
Transfers Outside Bargaining Unit. An employee voluntarily transferred to a position outside of the bargaining unit shall not accumulate seniority during such period of employment outside the bargaining unit. Such employee will, however, be entitled to retain his original seniority (less time spent outside the bargaining unit) in the event of transfer back into the bargaining unit within one year immediately following transfer to the outside position. An employee transferring back to the bargaining unit will be transferred to the Sweeper job classification.

If the employee reverts back to a position in the bargaining unit, they will be required to pay a maximum of three (3) months’ union dues for the period of exclusion. After the above-mentioned three (3) month period, employees shall lose all their seniority rights.
Transfers Outside Bargaining Unit unit member who accepts a job in the District outside of the bargaining unit (without a break in service) shall maintain his/her previous job classification and bargaining unit seniority. If he/she resumes his/her employment at some future date in the bargaining unit [without a break in service] he/she shall resume his/her job classification seniority (if he/she goes to the same classification) and his/her bargaining unit seniority. The period of time spent in a District position outside of the bargaining unit shall only count toward District seniority.
Transfers Outside Bargaining Unit. 11.01 If an Employee who has acquired seniority status is or has been transferred to an occupation not covered by this Agreement or to a supervisor position, he/she shall continue to accrue seniority for a period of six (6) months. If an Employee is subsequently transferred back to an occupation covered by this Agreement, he/she shall retain his/her prior seniority plus the time (up to six (6) months) spent outside the bargaining unit and continues to accrue seniority thereafter.
Transfers Outside Bargaining Unit. An employee who accepts a position with the County as an employee not included in this bargaining unit shall maintain all accumulated seniority to date of transfer. Upon applying to return to the bargaining unit, said employee shall comply with the posting requirements for the vacant position including having the presently required qualifications, education and skills.
Transfers Outside Bargaining Unit a) No Employee shall be transferred to a position outside the bargaining unit without her consent. If an Employee is transferred to a position outside of the bargaining unit, they shall retain their seniority accumulated up to the date of leaving the unit but will not accumulate any further seniority within the bargaining unit. Such Employee will have the right to return, or may
b) be returned by the Employer to her position in the bargaining unit at any time within the trial period which may be for up to three (3) consecutive months. If an Employee returns or is returned to the bargaining unit, they shall be placed in a job consistent with her seniority and qualifications. Such return shall not result in the layoff or bumping of an Employee holding greater seniority.

It is understood and agreed that an Employee who consents to transfer, for any reason, to a position which they know to be outside the Bargaining Unit, shall not then initiate proceedings to have that position included in the Bargaining Unit. Such Employees who are transferred to a permanent position outside the Bargaining Unit shall continue to accumulate seniority for a period of only 6 months, but during this time they cannot maintain their membership in the Union. If the Employee reverts back to a position in the Bargaining Unit, they will be required to pay the Union dues owing retroactive to the time of their appointment outside the Union. After the above mentioned 6 month period, Employees shall lose all their seniority rights.
