The CM. The CM shall require in its bid specifications for all work within the scope of Article 3 and Exhibit C that all successful bidders, and their subcontractors of whatever tier, become bound by, and signatory to, this Agreement. It is understood that nothing in this Agreement shall be construed as limiting the sole discretion of the CM in determining which Contractor or Subcontractor shall be awarded contracts for Project work. It is further understood that the Contractor has sole discretion at any time to terminate, delay or suspend the work, in whole or part, on this Project. The CM agrees that neither it nor any of its Contractors or Subcontractors will subcontract any work to be done on the Project except to a person, firm or corporation who is or agrees to become party to this Agreement. Any Contractor or subcontractor working on the Project shall, as a condition to working on said Project, become signatory to and perform all work under the terms of this Agreement.
The CM. GC shall provide a preliminary evaluation of Owner’s program and budget requirements, each in terms of the other, within one week after receiving documents from the architect.
