SUBORDINATION OF LEASEHOLD. Lessee agrees that this Lease is and shall be, at all times, subject and subordinate to the lien of any mortgage or other encumbrances which Lessor may create against the Premises including all renewals, replacements and extensions thereof; provided, however, that regardless of any default under any such mortgage or encumbrance or any sale of the Premises under such mortgage, so long as Lessee performs all covenants and conditions of this Lease and continues to make all payments hereunder, this Lease and Lessee's possession and rights hereunder shall not be disturbed by the mortgagees or anyone claiming under or through such mortgages. Lessee agrees to execute any and all instruments in writing which may be required by Lessor to subordinate Lessee's rights to the lien of such mortgage.

SUBORDINATION OF LEASEHOLD. Lessee agrees that this Lease is and shall be, at all times, subject and subordinate to the lien of any mortgage or other encumbrances which Lessor may create against the Premises or the Property, or both, including all renewals, replacements and extensions thereof, provided, however, that regardless of any default under any such mortgage or encumbrance or any sale of the Premises under such mortgage, so long as Lessee performs all covenants and conditions of this Lease and continues to make all payments hereunder, this Lease and Lessee's possession and rights hereunder shall not be disturbed by the mortgagee or anyone claiming under or through such mortgagee. Lessee agrees to execute any and all instruments in writing which may be required by Lessor to subordinate Lessee's rights to the lien of such mortgage. Lessee's subordination is only effective in favor of a future lender so long as such lender, on behalf of itself and any purchaser at a foreclosure sale, agrees in writing to recognize all rights of Lessee under the Lease.

SUBORDINATION OF LEASEHOLD. Lessee agrees, upon request by Lessor, to subordinate its leasehold interest to the lien of any bona fide mortgage that may be procured by Lessor on the leased premises, provided that the mortgagee of such mortgage shall permit Lessee to remain in possession of the leased premises as long as Lessee complied with and performs all of its covenants and undertakings under this Lease.
SUBORDINATION OF LEASEHOLD. This Lease is and shall be at all times, subject and subordinate to the lien of any mortgage or other encumbrances which Landlord may create against the Property, including all renewals, replacements and extensions. Tenant shall execute all written instruments which may be required by Landlord to subordinate Tenant's rights to the lien of such mortgage which obligation by Tenant is conditioned upon the holder of such lien providing to Tenant a written subordination, non disturbance, and attornment agreement, in a form reasonably acceptable to Tenant, providing, in essence, that as long as Tenant is not in default under the provisions of this Lease (after notice and the expiration of any grace period provided for in the Lease), the lender will, in the event of a foreclosure, recognize the interest of Tenant to remain in possession of the Premises under the Lease for the duration of the unexpired Term (and any extensions provided for in this Lease). Landlord shall use its best efforts to have all lenders currently secured by the Property to provide Tenant with a non disturbance agreement within 30 days of the date this Lease is executed by Landlord and Tenant.
SUBORDINATION OF LEASEHOLD. This Lease shall, at all times, be subordinate to the lien of any loan that Landlord may secure with the Property. Landlord shall obtain a non-disturbance agreement from the lender secured by the Property at the time Tenant first occupies the Property, which agreement shall provide that absent Tenant's default, the lienholder will allow Tenant to remain in possession of the Premises, subject to the provisions of this Lease, for the duration of the Term. Landlord shall use its best efforts to obtain a similar non-disturbance agreement from any and all subsequent lenders secured by the Property during the Term. Tenant

Lessee agrees to execute and deliver to Lessor, or to Lessor's designated agent, within ten (10) days after demand, a Subordination, Attornment and Non-Disturbance Agreement in form acceptable to any present or future lender requesting the same and which is substantially in the form attached hereto as Exhibit D or contains such other or different terms which are then customary in the commercial lending industry for loans of the type being contemplated so long as the substance of the aforesaid non-disturbance provision is also present.
