Statistical and Pattern Information. Despite anything else in the Agreement, the Supplier may monitor the Customer’s use of the Services and use data related to Customer’s use of the Services or the results of the Services in an aggregate and anonymous manner, including to compile statistical and performance information related to the provision and operation of the Services. The Customer agrees that the Supplier may make such information publicly available, provided that such information does not incorporate any Customer Data or identify any Customer individually. The Supplier retains all rights, title and interest in and to such information, including all associated Intellectual Property Rights. Notwithstanding clause 7.3(a), the Customer hereby grants the Supplier a limited, irrevocable license to utilize natural patterns occurring in the Customer Data to build derived sample anonymous data sets which may be used by the Supplier for purposes of development, testing, marketing materials, and visual demonstrations to potential Customers regarding the Supplier’s capabilities.   • Statistical Information Any third-party statistical and market-related data included in the Registration Statement, the Time of Sale Disclosure Package and the Prospectus are based on or derived from sources that the Company believes to be reliable and accurate in all material respects.

  • Statistical Analysis 31 F-tests and t-tests will be used to analyze OV and Quality Acceptance data. The F-test is a 32 comparison of variances to determine if the OV and Quality Acceptance population variances 33 are equal. For clarification, the disclosure by EPIZYME to EISAI of Product Information shall not cause such Product Information to cease to be subject to the provisions of this Section 9.2 with respect to the use and disclosure of such Confidential Information by EPIZYME. In the event this Agreement is terminated pursuant to Article 12, this Section 9.2 shall have no continuing force or effect, but the Product Information, to the extent disclosed by EPIZYME to EISAI hereunder, shall continue to be Confidential Information of EPIZYME, subject to the terms of Sections 9.1 and 9.3 for purposes of the surviving provisions of this Agreement. Each Party shall be responsible for compliance by its Affiliates, and its and its Affiliates’ respective officers, directors, employees and agents, with the provisions of Section 9.1 and this Section 9.2.
