Settlement Claims Administrator Responsibilities. The Settlement Claims Administrator shall be responsible for: (a) establishing a qualified settlement fund and qualified settlement fund account, and determining and finalizing the calculations of the Potential Gross Settlement Payments and tax withholding amounts for the Qualified Claimants; (b) preparing, printing and disseminating to the Named Plaintiff and Potential Opt-in Plaintiffs the Notice Packet and return envelope; (c) copying counsel for all Parties on material correspondence and promptly notifying all counsel for the Parties of any material requests or communications made by any Party or Potential Opt-In Plaintiff who receives a Notice Packet; (d) receiving and reviewing the Consent to Join and Release Forms submitted by the Named Plaintiff and Potential Opt-In Plaintiffs to determine eligibility for payment; (e) determining the final Settlement Payment for each Qualified Claimant in accordance with this Agreement; (f) mailing the Settlement Payments to Qualified Claimants; (g) wiring Plaintiff’s Counsel’s attorneys’ fees, expenses, and costs and mailing the General Release Payment and Settlement Payments in accordance with this Agreement and Order of the Court; (h) paying all payroll tax obligations of Defendant in accordance with applicable law and this Agreement; (i) issuing W-2 and 1099 3 In such an event, all dates referenced in this Agreement based on the entry of an Approval Order will instead be calculated from the later of (a) the date upon which the appeal is withdrawn, or (b) any appellate decision affirming the Approval Order becomes final. Forms for all amounts paid to Qualified Claimants; (j) ascertaining current address and addressee information for each Notice Packet returned as undeliverable; (k) referring to Plaintiff’s Counsel all inquiries by the Named Plaintiff and Potential Opt-in Plaintiffs the Settlement Claims Administrator cannot resolve and/or which involve matters not within the Settlement Claims Administrator’s duties specified herein; (l) responding to inquiries of Plaintiff’s Counsel or Defendant’s Counsel; (m) promptly apprising counsel for the Parties of the activities of the Settlement Claims Administrator; (n) maintaining adequate records of its activities, including the date of the mailing of the Notice Packets and receipt of Consent to Join and Release Forms, returned mail and other communications and attempted written or electronic communications with the Named Plaintiff and Potential Opt-in Plaintiffs; (o...

  • Claims Administrator A. The Human Resources Director through his/her designated Claims Administrators shall administer the provision of this policy. The City Physician shall provide the City's Claims Administrators with all available medical information concerning the Employee's injury and/or medical opinions as requested. Medical information and opinions shall be based upon the Employee's medical records and/or physical examination. Questions of Employee eligibility shall be determined by the provisions established under State Statute 49-110, 49-111 and Oklahoma Worker's Compensation Title 85. Prior to any denial of injury leave benefits where lost time actually occurred, the administrator shall notify Union and allow a Union representative the opportunity to review the application pending denial and provide any additional information relating to same as may be necessary. Should the City change designated Claims Administrators Local 176 will be notified in writing.

  • Contractor Responsibilities 19.1. Contractor shall perform national criminal history checks for Ohio, Indiana, and Kentucky, and 10-panel drug screening tests on all prospective employees performing work under this RFP or coming onto a CMHA property and any resulting contract and provide summaries of the results to the Authority if requested. For the purposes of this section, the term “employees” includes contractor. Prospective employees whose criminal background check discloses a misdemeanor or felony involving crimes of moral turpitude, sexual offenses or harm to persons or property shall not be employed to perform work under this RFP or any resulting contract. Contractor is required to perform drug screening of all employees and to ensure acceptable test results. Criminal history and drug screening checks will be completed at the sole expense of the contractor. Any employee of the Contractor suspected of being under the influence of drugs and or alcohol will be reported to the appropriate personnel at CMHA and/or other local law enforcement. If the employee is determined to be under the influence of drugs or alcohol in any form or manner, or believed by proper authority to be dealing in illicit sale of alcohol or drugs they will be removed and shall not be allowed to return to any job site on the Authority’s property. The Contractor’s contract may be suspended and/or terminated should such a situation occur or if the Contractor fails to submit results pursuant to this section.
