Services by Merchant. 7.1. Where the Grower delivers Horticulture Produce to the Merchant that is not the required delivery address the Merchant will provide a Freight Forwarding Service to the correct address and will deduct a pallet rate freight fee from the Growers weekly report under subclause 3.2 which is subject to change and communicated electronically.
Services by Merchant. 7.1. The Merchant will supply bins or crates to the Grower as (if) required.
Services by Merchant. The Merchant will supply the Service (if any) to the Grower. The Grower will pay Additional Fees for Services referred to in clause 6.1 and provided by the Merchant as set out in the Schedule. The amount to be paid by the Grower for the Service provided by the Merchant shall be calculated upon the Service being completed. The Grower will pay the amount calculated under clause 6.3 within the number of Business Days of the Merchant providing the Service specified in the Schedule. Liability of Grower The Grower shall be liable to insure (for defined events including fire, theft and accidental damage and other than deterioration of quality or any other inherent losses) the Produce until Delivery and the Merchant shall not be liable for any loss or damage to the Produce by the Grower’s failure to do so. The Grower shall be liable to compensate the Merchant for all direct losses, damages, costs, claims and expenses which the Merchant may incur as a result of any act or omission of the Grower other than to the extent that the loss, damage, claim or cost was contributed to by a negligent act or omission by the Merchant.
Services by Merchant. 6.1 The Merchant will supply the Service (if any) to the Grower if requested/agreed by the Grower.

  • Related Services Licensee shall be responsible for obtaining and installing all proper hardware and support software (including operating systems) and for proper installation and implementation of and training concerning the Licensed Software. In the event that Licensee retains Licensor to perform any services with respect to the Licensed Software (for example: installation, implementation, maintenance, consulting and/or training services), Licensee and Licensor agree that such services shall be subject to Licensor’s then current standard terms, conditions and rates for such services unless otherwise agreed in writing by Licensor.

  • Access to Services Subject to and in accordance with the terms of this Agreement, including any Schedules, Company grants You a non-exclusive, non-sublicensable, nontransferable, non-assignable, revocable license for the term of this Agreement to access and use the Services. Services may only be used by Your Users for internal business purposes only. You agree to comply with the terms and conditions of this Agreement, including any Schedules, and with all applicable Company procedures and policies that further define use of the Services.   • Hosted Services We shall use commercially reasonable efforts to make the Hosted Services you have purchased available 24 hours a day, 7 days a week, except for: (a) planned downtime under our direct control (of which we shall give at least 8 hours notice via the Hosted Services and which we shall schedule to the extent practicable during the weekend hours from 6:00 p.m. Pacific time Friday to 3:00 a.m. Pacific time Monday), (b) to the extent we are notified by third party service providers of planned downtime (of which we shall provide such notice to you via the Hosted services as soon we can reasonably do so), or (c) any unavailability caused by circumstances beyond our reasonable control, including, without limitation, acts of God, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes or other labor problems, internet service or third party hosting provider failures or delays ("Force Majeure"). Hosted Services are provided in accordance with applicable laws and government regulations.
