Seniority Bypass Sample Clauses
A Seniority Bypass clause allows an employer to promote, transfer, or assign employees without strictly adhering to the established order of seniority. In practice, this means that less senior employees may be selected for certain positions or opportunities over more senior colleagues, often based on merit, skills, or other business needs. The core function of this clause is to provide flexibility in workforce management, enabling the employer to make staffing decisions that best serve operational requirements rather than being bound solely by length of service.
Seniority Bypass. Seniority may only be bypassed where the Employer establishes the need for special skills and qualifications.
Seniority Bypass. An applicant may be passed over for a qualified less senior employee when there are significant and profound circumstances, relevant to the employee’s success in the new position, in the employee’s work history such as documented performance concerns or the employee has been issued disciplinary action pursuant to Section 10.
1. Any applicant who is passed over in seniority shall be given notice of such fact together with reason at least three (3) workdays prior to the date the position is to be permanently filled.
Seniority Bypass. If the District determines that seniority shall not govern in job vacancies and layoff because a junior employee possesses qualifications greater than a senior employee, the District shall set forth in writing to the affected employee and chapter president its reasons why he/she was bypassed.
Seniority Bypass. Any employee applying for a position opening who is passed over in seniority shall be given a written explanation of the bypass upon request. The request must be submitted within five (5) workdays after the employee was notified that he or she was not selected, and the written explanation shall be provided within five (5) workdays of the request. Any employee applying for a position may request a meeting with District personnel to identify and discuss the reasons that person was not selected. The sole purpose of such meeting would be to give the employee feedback on areas of strength and areas needing improvement to enhance the potential for selection in the future.
