Safety, Testing and Certification. Seller will comply with, and ensure that all Products comply with, all product safety, testing, standards and certification requirements under applicable Law, including without limitation, the Canada Consumer Product Safety Act and the regulations thereunder and any applicable provincial consumer protection legislation. Walmart may, from time to time, request Seller to submit its Product for testing with an independent testing lab acceptable to Walmart. Seller shall complete such testing within the timeframe reasonably requested by Walmart and shall bear all costs and expenses related thereto.
Safety, Testing and Certification. Seller will comply with, and ensure that all Products comply with all product safety, testing and certification requirements under applicable Law, including without limitation, the Consumer Product Safety Act, as amended, the Consumer Product Safety Improvement Act of 2008, as may be amended from time to time, the Federal Hazardous Substances Act, as may be amended from time to time, and all other Law under the jurisdiction of the Consumer Product Safety Commission ("CPSC"). Seller will obtain copies of GCCs from its suppliers or manufacturers for all Products for which a GCC is required under applicable Law. Seller will promptly notify XxxxxxxxXxxxxxxxx.xxx in writing of all warnings, disclaimers or any other similar notices required by applicable Laws to be posted with respect to Products.
Safety, Testing and Certification. The Seller will comply with, and ensure that all Products comply with, all product safety testing and certification requirements under the applicable Law, and all other Law. The relevant safety compliance documentation shall be uploaded onto the Seller Portal before the item is made active for the first time by the seller. The seller hereby indemnifies Makro in respect of the products listed by the seller and sold on Makro Marketplace against any loss and/or damages that may be suffered as a result of Makro selling the Products online.

  • COMPLIANCE AND CERTIFICATION 25.1 Each Party shall comply at its own expense with all Applicable Laws that relate to that Party’s obligations to the other Party under this Agreement. Nothing in this Agreement shall be construed as requiring or permitting either Party to contravene any mandatory requirement of Applicable Law.

  • Licensing and Certification The Grantee shall ensure that all licensed and/or certified staff maintain a current license and/or certification if the programs and services associated with State Aid Commitment Diversion funds require professional licensure or certification.

  • Evaluation, Testing, and Monitoring 1. The System Agency may review, test, evaluate and monitor Grantee’s Products and services, as well as associated documentation and technical support for compliance with the Accessibility Standards. Review, testing, evaluation and monitoring may be conducted before and after the award of a contract. Testing and monitoring may include user acceptance testing. Neither the review, testing (including acceptance testing), evaluation or monitoring of any Product or service, nor the absence of review, testing, evaluation or monitoring, will result in a waiver of the State’s right to contest the Grantee’s assertion of compliance with the Accessibility Standards.

  • Drug-Free Workplace Certification As required by Executive Order No. 90-5 dated April 12, 1990, issued by the Governor of Indiana, the Contractor hereby covenants and agrees to make a good faith effort to provide and maintain a drug-free workplace. The Contractor will give written notice to the State within ten (10) days after receiving actual notice that the Contractor, or an employee of the Contractor in the State of Indiana, has been convicted of a criminal drug violation occurring in the workplace. False certification or violation of this certification may result in sanctions including, but not limited to, suspension of contract payments, termination of this Contract and/or debarment of contracting opportunities with the State for up to three (3) years. In addition to the provisions of the above paragraph, if the total amount set forth in this Contract is in excess of $25,000.00, the Contractor certifies and agrees that it will provide a drug-free workplace by:

  • ISO 9001 Certification The Contractor shall maintain or exceed their ISO 9001 Certification and submit updates, if applicable

  • CERTIFICATION REGARDING DRUG-FREE WORKPLACE REQUIREMENTS The undersigned (authorized official signing for the contracting organization) certifies that the contractor will, or will continue to, provide a drug-free workplace in accordance with 45 CFR Part 76 by:

  • RECYCLING CERTIFICATION The Contractor shall certify in writing under penalty of perjury, the minimum, if not exact, percentage of post consumer material as defined in the Public Contract Code Section 12200, in products, materials, goods, or supplies offered or sold to the State regardless of whether the product meets the requirements of Public Contract Code Section 12209. With respect to printer or duplication cartridges that comply with the requirements of Section 12156(e), the certification required by this subdivision shall specify that the cartridges so comply (Pub. Contract Code §12205).

  • Random Drug Testing All employees covered by this Agreement shall be subject to random drug testing in accordance with Appendix D.

  • Quality Assurance Requirements There are no special Quality Assurance requirements under this Agreement.
