ROAD CROSSINGS. Grantor shall have the right to cross the Easement herein granted with a private paved or concrete driveway, roadway or sidewalk; provided, however, that any such new crossings will (i) be at an angle of between 75 to 90 degrees, and (ii) not result in the cover over the pipeline being reduced to less than three (3) feet. Grantor shall provide Grantee with at least fourteen (14) days written notice prior to the construction of such road. Notwithstanding the foregoing, and provided that sufficient depth of the pipe is maintained, Grantor may use the road currently located on the property. In performing such construction or installing such road crossings, Grantor shall defend, indemnify, and hold harmless the Grantee from all cost, loss, damage, expense, or claims of any nature arising from or in any way related to Grantor’s activities. Xxxxxxx acknowledges and consents to the right of the Grantor to perform such improvements provided it does not interfere with the rights granted to Grantee herein. In the event the Grantee elects to repair, upgrade, expand or extend the Pipeline Facilities, or any other area contained in and described by this Easement, and such action requires the removal of or damage to any such improvements as described in this Section, the parties agree that any cost or labor required to restore any damage to the Grantor’s improvements shall be the sole responsibility of the party performing the removal or causing the damage to any such improvements as described in this Section. Grantee shall not be responsible for damage to road crossings constructed after installation of the Pipeline Facilities.

ROAD CROSSINGS. Delete the last sentence of this subclause and substitute: The ducts shall be laid to the lengths shown on the drawings or as directed by the Engineer.
ROAD CROSSINGS. (i) "Tarmac or Asphalt Road" means the road surface, which is metalled by sphalt/tarmac normally having compacted strata below the metalled surface, irrespective of thickness of asphalt/tarmac.
ROAD CROSSINGS. The standard for a road crossing surface installed and maintained by the BNSF is concrete plank (for 136-lb. rail) placed on 10-ft. switch ties. Also, ten 10-ft. switch ties are placed on both ends of the crossing, replacing any standard cross-ties. For crossings installed and maintained by the Customer, a concrete plank is recommended, with a wood plank surface as acceptable (see appendix, pages A-21 to 23).
ROAD CROSSINGS. Where the Design requires one or more road crossings, which will be formed before service trenches are opened, Enable will provide the road crossing duct to be installed by the Developer at road crossing points to facilitate cables being pulled through at later dates. These road crossings will be indicated in the Build Pack. These ducts are only to be used by Enable. Ducting cannot be utilised by any other utility provider to provide cross road connections.
ROAD CROSSINGS. A. All road crossings shall be bored. No cut and patch shall be allowed.

  • Infrastructure (a) The Borrower has and will maintain a sufficient infrastructure to conduct its business as presently conducted and as contemplated to be conducted following its execution of this Agreement.

  • Dewatering 4.7.1 Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, all non- trades employees shall assist in ‘dewatering’ their own work site or area if it is so affected. Such work to be paid at single time rates. Productive work will continue in areas not so affected.

  • Dark Fiber Loop 2.8.4.1 Dark Fiber Loop is an unused optical transmission facility, without attached signal regeneration, multiplexing, aggregation or other electronics, from the demarcation point at an End User’s premises to the End User’s serving wire center. Dark Fiber Loops may be strands of optical fiber existing in aerial or underground structure. BellSouth will not provide line terminating elements, regeneration or other electronics necessary for AFN to utilize Dark Fiber Loops.

  • Moonlighting 24.01 The Company and the Union agree in principle to eliminate the practice commonly referred to as moonlighting.

  • ELECTRICAL SERVICES A. Landlord shall provide electric power for a combined load of 3.0 xxxxx per square foot of useable area for lighting and for office machines through standard receptacles for the typical office space.

  • Dark Fiber Transport Dark Fiber Transport is defined as Dedicated Transport that consists of unactivated optical interoffice transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics. Except as set forth in Section 6.9.1 below, BellSouth shall not be required to provide access to Dark Fiber Transport Entrance Facilities pursuant to this Agreement.

  • System Logging The system must maintain an automated audit trail which can 20 identify the user or system process which initiates a request for PHI COUNTY discloses to 21 CONTRACTOR or CONTRACTOR creates, receives, maintains, or transmits on behalf of COUNTY, 22 or which alters such PHI. The audit trail must be date and time stamped, must log both successful and 23 failed accesses, must be read only, and must be restricted to authorized users. If such PHI is stored in a 24 database, database logging functionality must be enabled. Audit trail data must be archived for at least 3 25 years after occurrence.

  • Online Services Microsoft warrants that each Online Service will perform in accordance with the applicable SLA during Customer’s use. Customer’s remedies for breach of this warranty are in the SLA. The remedies above are Customer’s sole remedies for breach of the warranties in this section. Customer waives any breach of warranty claims not made during the warranty period.
