Rights and Obligations of the Creditor. V. 1 The creditor shall have the right to recover the loan principal and the interest (inclusive of the compound interest and the penalty interest for overdue and appropriated loan), collect from the borrower the expense(s) payable, and exercise other rights as regulated by the relevant laws or specified in this Contract.

The Creditor undertakes: to provide the Provider of Surety at his request with the information about the fulfilment of the obligation on the part of the Main Debtor; to hand over to the Provider of Surety, after the Provider of Surety has fulfilled the obligations specified in clause 1.1, all of the documents that confirm the claim against the Main Debtor. If the Main Debtor has not fulfilled his obligations arising from the rental contract appropriately and in due time, the Creditor has the right to claim for the performance of the rental contract either from the Main Debtor or from the Provider of Surety or from both at his own discretion. Final provisions Changes can be made in the Contract at the written agreement of the Parties. The Parties confirm that they have all of the powers, approvals, and consents arising from legal acts, required for the conclusion of the Contract and the fulfilment of the obligations arising from it. As for the issues that are not governed by the Contract partially or in full, the Parties shall proceed from legal acts that are valid in the Republic of Estonia, mainly from the provisions of the Law of Obligations Act. Disagreements and disputes arising from the fulfilment, interpretation, changes in or termination of the Contract shall be resolved by means of negotiations. If it is not possible to reach an agreement, they should be resolved in Xxxxx County Court in accordance with the procedure established in the legislation of the Republic of Estonia. The Contract has been drawn up in two copies, and each of the Parties shall get one copy of the Contract. Rights and Obligations of the Creditor. 7.1 The Creditor is entitled to demand the Guarantor at any time to provide the financial report, financial information or other materials concerning the business operation and financial status of the Guarantor. 7.2 In case of default by the Obligor upon the date of expiry stipulated in the relevant agreements/contracts entered into under the Master Agreement or the date of expiry as declared by the Creditor, the Creditor is entitled to demand the Guarantor to bear joint and several liability in accordance with this Contract. 7.3 In case that the Guarantor fails to perform its obligation of guaranty, the Creditor is entitled to transfer the relevant amount of money from the account of the Guarantor in Minsheng Bank of China to settle the indebtedness. And the Creditor is entitled to demand the Guarantor to pay for the unsettled indebtedness.
