Reporting of Disclosures of Protected Health Information. Data Recipient shall notify EMS Authority in writing of any use or disclosure of the Data in violation of this Agreement by Data Recipient, its officers, directors, employees, contractors or agents, or by any third party, as soon as is practicable after Data Recipient obtains knowledge of any such violation.

PHO shall, as soon as reasonable practical after becoming aware of an unauthorized use or disclosure of Protected Health Information, by PHO, its employees, contractors, or agents which is in violation of this Agreement or HIPAA, notify Provider of such use or disclosure, the circumstances surrounding the use or disclosure, and a description of the Protected Health Information so used or disclosed.

In such event, the Vendor shall, in consultation with the Covered Entity, mitigate, to the extent practicable, any harmful effect that is known to the Vendor of such improper use or disclosure.

Contractor shall, within five (5) business days (Monday - Friday) of becoming aware of a use or disclosure of PHI in violation of this Contract by Contractor or Contractor Agents, report such disclosure or use in writing to Xxxxx Xxxxxx in the Employee Benefits Division of the City’s Human Resources Department and describe remedial action taken or proposed to be taken with respect to such use or disclosure.

Seller shall, within thirty (30) days of becoming aware of any Security Incident (as defined in the Security Rule) or any use or disclosure of PHI in violation of this Addendum by Seller, its officers, directors, employees, contractors or agents or by a third party to which Seller disclosed PHI pursuant to Section II.4 of this Addendum, report any such disclosure to Purchasing Partners and applicable Participating Members.
