Regional Sewage Solution. (i) RFA shall construct the Regional Sewage Solution during Phase I. The Regional Pump Station shall be designed and constructed in the location shown on the Revised Land Development Plans with sufficient capacity to accommodate the sewage flows from the Proposed Development together with not less than 220 Equivalent Dwelling Units (“EDUs”) for the BHFB Properties as well as the number of EDUs that are projected for the Off- Site Properties and so as to receive the conveyance of sewage from the BHFB Properties by gravity. The Township shall allocate for BHFB sewage capacity for not fewer than 220 EDUS. The Revised Land Development Plans include the design of all aspects of the Regional Sewer Solution, including the design of the pumping station, sewer mains, and related facilities. Upon receipt of all required permits and approvals, the Regional Sewer Solution shall be constructed by RFA in accordance therewith and with all applicable governmental requirements and dedicated to the Township. Township agrees to accept dedication of the improvements included within the Regional Sewer Solution including, without limitation, the sewer main from the Regional Pump Station to its interconnection point with the Philadelphia sewer system, provided such improvements are constructed according to Township standards. At the time that the final plans are recorded, RFA will also record such easements as are necessary to permit BHFB and the Township (on behalf of the Off-Site Properties) to install sewer lines across the RFA Property and connect to the Regional Pump Station. The form of such easements are attached hereto as Exhibit “ ”.

Regional Sewage Solution. If within thirty (30) days after RFA obtains approval of the Preliminary Land Development approval for the Proposed Development from the Township for the Proposed Development (and as to BHFB’s Opposition to the Proposed Development at all times thereafter) BHFB (i) permanently ceases BHFB’s Opposition to the Proposed Development; and (ii) notifies RFA and the Township that it elects to participate in the construction and use of the Regional Sewage Solution and posts with the Township satisfactory financial security for BHFB’s Share of Regional Sewer Costs, RFA shall, subject to receiving necessary governmental approvals, construct the Regional Sewage Solution in accordance with the approved Preliminary Land Development Plans. If the Regional Sewage Solution proceeds, RFA shall provide the details of necessary easements on its Property, including easements across the Pencoyd Bridge, to the Township and BHFB for review and approval prior to the release of the Final Land Development plans for recording. During the construction of the Regional Sewage System RFA shall be entitled to draw upon the financial security for BHFB’s Share of Regional Sewer Costs posted by BHFB using the procedure contained in Section 510 of the Pennsylvania Municipalities Planning Code (“MPC”). ***** BHFB shall have the right to connect as soon as the Regional Pump Station is operational and it releases BHFB’s contribution to RFA. The Regional Pump Station shall be designed and constructed with sufficient capacity to accommodate the sewage flows from the Proposed Development together with not less than 204 EDUs from the BHFB Properties as well as the projected EDUs for the Off-Site Properties and so as to receive the conveyance of sewage from the BHFB Properties by gravity. RFA shall at no cost to BHFB and simultaneously with the recording of the Final Land Development Plans, grant to BHFB such perpetual easements over the RFA Property as may be reasonably be required by BHFB for the purpose of access, construction, connection and maintenance of a gravity sewer line servicing the BHFB Properties to the Regional Pump Station.

  • Ambulance Services Ground Ambulance This plan covers local professional or municipal ground ambulance services when it is medically necessary to use these services, rather than any other form of transportation as required under R.I. General Law § 27-20-55. Examples include but are not limited to the following: • from a hospital to a home, a skilled nursing facility, or a rehabilitation facility after being discharged as an inpatient; • to the closest available hospital emergency room in an emergency situation; or • from a physician’s office to an emergency room. Our allowance for ground ambulance includes the services rendered by an emergency medical technician or paramedic, as well as any drugs, supplies and cardiac monitoring provided. Air and Water Ambulance This plan covers air and water ambulance services when: • the time needed to move a patient by land, or the instability of transportation by land, may threaten a patient’s condition or survival; or • if the proper equipment needed to treat the patient is not available from a ground ambulance. The patient must be transported to the nearest facility where the required services can be performed and the type of physician needed to treat the patient’s condition is available.   • STATEWIDE CONTRACT MANAGEMENT SYSTEM If the maximum amount payable to Contractor under this Contract is $100,000 or greater, either on the Effective Date or at any time thereafter, this section shall apply. Contractor agrees to be governed by and comply with the provisions of §§00-000-000, 00-000-000, 00-000-000, and 00- 000-000, C.R.S. regarding the monitoring of vendor performance and the reporting of contract information in the State’s contract management system (“Contract Management System” or “CMS”). Contractor’s performance shall be subject to evaluation and review in accordance with the terms and conditions of this Contract, Colorado statutes governing CMS, and State Fiscal Rules and State Controller policies.
