Common use of Procedure for Filing Complaints Clause in Contracts

Procedure for Filing Complaints.  The Union and the Employer recognize the right of employees to work in an environment free from harassment, including sexual harassment.  An employee who wishes to pursue a concern arising from an alleged harassment may register a complaint in writing with the Employer or through the Union to the Employer designate.  If a complaint is registered, it shall be handled in a timely manner in accordance with the Company’s harassment policies.  All persons involved with the complaint shall hold all aspects of the complaint and all related information in the strictest confidence. Failure to do so may result in discipline, up to and including dismissal.  Unresolved complaints of harassment may be pursued through the grievance procedure initiated after this process has been completed.  Both the complainant and the alleged harasser shall be entitled to Union representation if they are members of the bargaining unit.
