Post Occupancy Evaluation. If required by the Contract Administrator, the Contractor will do all things necessary to assist (including by advising and consulting to) the Contract Administrator to: carry out (or procure an Other Contractor to carry out) a post occupancy evaluation of the Works; and without limiting subparagraph (i): inspect the Works to review the extent to which the Contractor has complied with the ESD and WOL Plan and otherwise maximised the achievement of the ESD Principles and WOL Objectives in the design and construction of the Works; and issue a report to the Commonwealth and the Contractor: stating the extent to which the Contractor has complied with the ESD and WOL Plan and otherwise maximised the achievement of the ESD Principles and the WOL Objectives in the design and construction of the Works; and containing a list of any aspects of the Works which do not conform with the requirements of the Contract. The Contractor: must consult with the Contract Administrator, the Commonwealth and Other Contractors, and must provide such other assistance as is reasonably necessary, for the purposes of the Contract Administrator carrying out the requirements in paragraphs (i) and (ii); and acknowledges and agrees that the Commonwealth may take the results of the post occupancy evaluation into account in any registration of interest process, tender process or similar procurement process in connection with any other Commonwealth project.

Post Occupancy Evaluation. The Contract Administrator may: at any time carry out (or procure an Other Contractor to carry out) a post occupancy evaluation of the Works; and without limiting subparagraph (i): inspect the Works to review the extent to which the Consultant has complied with the ESD and WOL Plan and otherwise maximised the achievement of the ESD Principles and the WOL Objectives in the design and construction of the Works; and issue a report to the Commonwealth and the Consultant: stating the extent to which the Consultant has complied with the ESD and WOL Plan and otherwise maximised the achievement of the ESD Principles and the WOL Objectives in the design of the Works; and containing a list of any aspects of the Works which do not conform with the requirements of the Construction Contract, comparing the actual resource intensity performance to the predicted design performance target. The Consultant: must consult with the Contract Administrator, the Commonwealth and Other Contractors, and must provide such other assistance as is reasonably necessary, for the purposes of the Contract Administrator carrying out the requirements in subparagraphs (a)(i) and (a)(ii); and acknowledges and agrees that the Commonwealth may take the results of the post occupancy evaluation into account in any registration of interest process, tender process or similar procurement process in connection with any other Commonwealth project.
Post Occupancy Evaluation. If required by the Contractor's Representative the Consultant must do all things necessary to assist (including by advising and consulting to) the Contractor to: at any time carry out (or procure an Other Contractor to carry out) a post occupancy evaluation of the MCC Works; and without limiting paragraph (a): inspect the MCC Works to review the extent to which the achievement of the WOL Objectives has been maximised in the design and construction of the MCC Works; and issue a report to the Commonwealth: stating the extent to which the achievement of the WOL Objectives has been maximised in the design and construction of the MCC Works; and containing a list of any aspects of the MCC Works which do not conform with the requirements of the Managing Contractor Contract. The Consultant acknowledges that the results of the post occupancy evaluation may be used in the evaluation of future tenders submitted by the Consultant to the Contractor or the Commonwealth.
Post Occupancy Evaluation. The architect will schedule and conduct a 3-month and 10-month post occupancy evaluation of each project sitof the projecte.

Consent of the Design-Builder to partial occupancy or use shall not be unreasonably withheld. The stage of the progress of the Work shall be determined by written agreement between the Owner and Design-Builder.

  • Period of Occupancy The student may occupy an assigned room at the time specified by the university each semester. If the student fails to occupy the room by 5:00 p.m. on the first day of classes, the university reserves the right to reassign the space or initiate a contract cancellation. However, failure to occupy an assigned space does not automatically release the student from contractual obligation. Occupancy of the room must be relinquished at the completion of the contract. University housing facilities are closed during the periods between semesters, the Thanksgiving holiday and spring break. Residents who are not graduating are required to check out of their residence halls within 24 hours after their last exam but no later than 5:00p.m. on the last day of the exam schedule.

  • Termination of Occupancy Upon termination of occupancy of a County Assisted Unit by a Tenant, such Unit will be deemed to be continuously occupied by a household of the same income level as the initial income level of the vacating Tenant, until such unit is reoccupied, at which time categorization of the Unit will be established based on the occupancy requirements of Section 2.1.

  • Guests; Occupancy Limits No more than one person may occupy a bedroom space, except for minor children for whom the Resident is the parent or legal guardian with Owner’s consent and with consent of apartment-mates as applicable . If Resident desires to have an Overnight Guest (any person staying in the Resident’s assigned bedroom space or apartment for more than three total nights in any 30-day period), then Resident must register the Overnight Guest(s) with Owner. Resident may not have Overnight Guest(s) for more than three consecutive nights, nor for more than six total nights in any 30-day period. In the event any unregistered or unauthorized Overnight Guest(s) are identified to be in or using an apartment or bedroom space, Owner may assess against the Resident a fee of $60 per night, in addition to the right of Owner to declare Resident in material breach of this Agreement and pursue other available remedies. Although Resident may have Guests from time to time, Owner reserves the right to restrict the number of persons permitted in or about an apartment at any time in Owner’s discretion, to protect safety and the quiet enjoyment of other residents. Guests may park only in designated guest parking areas, if any, and no Guest’s vehicle may remain at the Property for more than three days.

  • Owner Occupancy Participant(s) agree to maintain the property as their primary residence during the term of this Agreement, any extensions thereof, or until closeout, documentation is approved by NCORR. If during the term of the Grant Agreement, Participant(s) (1) use the property as an investment property (2) convert the structure to an ineligible structure type or use, or (3) uses the property as a recreational house or “second” home, then NCORR may require immediate payment in full of the entire grant amount provided to the Participant(s). Participant(s) agree that if during the term of this Agreement, any extensions thereof or prior to closeout, Participant(s) sell part or all of the property without NCORR’s prior written consent, then NCORR may require payment in full the amount of the Grant outstanding at the time of sale.

  • Partial Occupancy The OWNER may occupy or use any portion of the Work at any stage. Immediately prior to such partial occupancy or use, the OWNER and Contractor shall jointly inspect the area to be occupied or portion of the Work to be used in order to determine and record the condition of the Work. The use or occupancy of a portion of the Work by OWNER or its other contractors to inspect and/or correct defective workmanship or install furniture, fixtures, or equipment or other work shall not be considered as use and occupancy. Unless otherwise agreed upon, partial occupancy or use of a portion or portions of the Work shall not constitute acceptance of Work not complying with the requirements of the Contract Documents.

  • MAINTENANCE OF THE BUILDING /APARTMENT / PROJECT The Promoter shall be responsible to provide and maintain essential services in the Project till the taking over of the maintenance of the project by the Association upon the issuance of the completion certificate of the Project. The cost of such maintenance has been included in the Total Extras and Deposits as mentioned in clause 1.2.
