Post Construction and Post VBWD Permit Closeout. The Owner will maintain and repair each Facility as follows: The integrity and intended function of all Facilities shall be preserved. If applicable, the maintenance shall be accordance with the manufacturer-specified maintenance. In the case of hydraulic conveyances and other structures, the hydraulic capacity shall be preserved. In the case of Facilities relying on soils and vegetation for stormwater management, the soil permeability shall remain permeable and the vegetation shall remain healthy. If necessary, Owner shall undertake at its expense periodic dredging or removal of silt buildup and other deposited materials within the Facility to maintain its treatment capacity and proper operation, as established in the construction plans. Owner will annually inform the VBWD of Facility conditions, actions taken and dates of the actions, and repair or maintenance needs. VBWD may annually inspect the Facility to ensure that it meets the minimum maintenance standards outlined above. Any maintenance needs noted during a VBWD inspection shall be conveyed to the Owner in a Notice of Maintenance Inspection Improvement Requirements mailed to Owner’s last known address, and shall be implemented within sixty (60) days of the date of mailing of the Notice. The Owner shall be solely responsible for the maintenance of the Facility, and shall bear all costs of such maintenance. If the Owner does not undertake the necessary maintenance, the VBWD may give notice to the Owner by mailing a Notice of Deficiency to the Owner’s last known address, detailing the deficiency. If the deficiency has not been corrected within sixty (60) days after mailing of the notice, or Owner has not made arrangements deemed adequate by the VBWD for the deficiency to be corrected within that period, then the VBWD upon five (5) days’ notice may correct the deficiency, and may have access to the property during reasonable times for that purpose. The VBWD may contract such maintenance, and the costs incurred by VBWD for contracting such maintenance, including but not limited to reasonable administrative, consultant, and attorney fees, shall be reimbursed to VBWD by the Owner.

The NYISO or the Connecting Transmission Owner shall provide the Interconnection Customer with five Business Days notice prior to such interruption. The NYISO and Connecting Transmission Owner shall use Reasonable Efforts to coordinate such reduction or temporary disconnection with the Interconnection Customer.

  • PRE-CONSTRUCTION PHASE SERVICES The Pre-Construction Phase shall be deemed to commence upon the date specified in a written Notice to Proceed with Pre-Construction Phase Services issued by Owner and shall continue through completion of the Construction Documents and procurement of all major Subcontractor agreements. Contractor is not entitled to reimbursement for any costs incurred for Pre-Construction Phase Services performed before issuance of the written Notice to Proceed. Pre-Construction Phase Services may overlap Construction Phase Services. Contractor shall perform the following Pre-Construction Phase Services:

  • CONSTRUCTION AND RENOVATION Construction of academic or residential buildings on the UC Berkeley campus may be scheduled for the term of this Lease in the vicinity of the apartments. Capital improvement and other major housing construction or repair projects will necessarily cause increased noise and dust in affected and nearby residences at certain times. There is the possibility of both planned and unplanned utility shutdowns and access to certain facilities, streets, parking lots, walking, and bike pathways may be limited, rerouted, or completely restricted. The University will work with building contractors to make every effort to minimize construction inconveniences. By agreeing to this Lease Agreement, the Resident acknowledges notice of the possibility of scheduled construction and access limitations, and acknowledges that there will be disturbances, disruptions, and inconveniences resulting from such constructions and has agreed to such. The Resident also acknowledges that increased noise, dust, potential reassignment, or loss of parking spaces related to construction or renovation are not grounds for cancellation or termination of this Lease.

  • Special Construction If, after an order is placed, Xxxxxxx finds that third-party special construction services are needed to build, configure or install any additional facilities and/or equipment necessary for Verizon to provide Access service, Verizon will notify the Customer of any such special construction charges. If Customer does not accept the special construction charges, Customer may terminate the order(s) affected by the special construction charges, with no cancellation fee(s).

  • FINAL COMPLETION AND FINAL PAYMENT 9.9.1 Upon receipt of written notice that the Work is ready for final inspection and acceptance and upon receipt of a final Application for Payment, the Architect will promptly make such inspection and, when he or she finds the Work acceptable under the Contract Documents and the Contract fully performed, he or she will promptly issue a final Certificate for Payment stating that to the best of his / her knowledge, information and belief, and on the basis of his or her observations and inspections, the Work has been completed in accordance with the terms and conditions of the Contract Documents and that the entire balance found to be due the Contractor, and noted in said final Certificate, is due and payable. The Architect's final Certificate for Payment will constitute a further representation that the Contractor has fulfilled the conditions entitling him or her to final payment as set forth in Subparagraph 9.9.2 of these General Conditions.
