Position Held Open for One Year. On the date the Assistant Superintendent commences a long-term disability (LTD) leave, the Assistant Superintendent's position will no longer be held open for the Assistant Superintendent. However, if the Assistant Superintendent is medically able to return to work within one calendar year of the date of the commencement of the leave, the Assistant Superintendent will be given consideration for placement in a vacant administrative position for which the Assistant Superintendent is certified (if applicable) and qualified, as determined by the Superintendent. Position Held Open for One Year. On the date an administrator commences a long-term disability leave, the administrator’s position will no longer be held open for the administrator. However, if the administrator is medically able to return to work within one calendar years of the date of the commencement of the leave, the administrator will be given consideration for placement in a vacant administrative or instructional position for which the administrator is certified and qualified, as determined by the Superintendent. (If the placement is in the teachers’ bargaining group, the placement is subject to the layoff and recall policies applicable to the Bloomfield Hills Education Association. The administrator must supply a physician’s authorization permitting the administrator to return to work and may be required to have a return-to-work examination by a physician or medical facility designated by the District. If the administrator’s physician and the district’s physician or medical facility do not agree that the administrator is medically able to return to work, an independent physician or medical facility, paid by the District, may examine the administrator, and this decision will be final. This paragraph does not apply to an administrator who retires. If the administrator does not return to work within one year from the commencement of the leave, the administrator will be separated from employment with Bloomfield Hills Schools.

  • Venue Limitation for TIPS Sales Vendor agrees that if any "Venue" provision is included in any TIPS Sale Agreement/contract between Vendor and a TIPS Member, that clause must provide that the "Venue" for any litigation or alternative dispute resolution shall be in the state and county where the TIPS Member operates unless the TIPS Member expressly agrees otherwise. Any TIPS Sale Supplemental Agreement containing a “Venue” clause that conflicts with these terms is rendered void and unenforceable.

  • Leave of Absence for Employees Who Serve as Local Coordinators for the Ontario Nurses' Association An employee who serves as Local Coordinator for the Ontario Nurses' Association shall be granted leave of absence without pay up to a total of thirty-five (35) days annually.   • Administrative and Operating Expenses Charged to the Judicial Council The Judicial Council may reimburse the Contractor for itemized administrative and operating expenses, pursuant to this exhibit, that are reasonable, allowable, and allocable in performing the Work of this Agreement, provided that the Judicial Council first approves such charges via one (1) or more BEO’s that set forth the final details on these items.

  • Coverage for Members Who Are Hospitalized on Their Effective Date If you are in the hospital on your effective date of coverage, healthcare services related to such hospitalization are covered as long as: (a) you notify us of your hospitalization within forty-eight (48) hours of the effective date, or as soon as is reasonably possible; and (b) covered healthcare services are received in accordance with the terms, conditions, exclusions and limitations of this agreement. As always, benefits paid in such situations are subject to the Coordination of Benefits provisions.
