Permitted Uses/Special Requirements. Tenant shall be responsible for the operation and management of the Tennis Facility and Improvements (excluding the Public Improvements), said operation to include, at Tenant’s discretion, tennis tournaments scheduled by Tenant, including up to four (4) national or regional tennis events per year (the “Major Tournaments”), tennis intramurals, classes, clinics, camps, exhibitions and general member and public use. The permitted use shall also include all ancillary and related uses as determined by Tenant, which may, but are not required, to include any or all of the following: sales of concessions, fitness, training classes or other services or programs normally offered by tennis facilities, and which may include the sublease of space to the USTA for administrative offices. In addition, Tenant may operate and manage non-tennis sporting and other community-based events at the Premises, as long as such events are within the scope of the RFP and are those events presented in Tenant’s response to the RFP which have been accepted and approved by the County and/or activities that are ancillary thereto. All such uses shall be deemed “permitted events” as described in this Lease. With respect to the Major Tournaments, said tournaments shall be at times and for a duration mutually agreed upon by the parties when County parking is required. Additional requirements relating to Tenant’s use of the Premises follow.
