Common use of Overtime Meal Period Clause in Contracts

Overtime Meal Period. In emergency situations where an employee is required to work four (4) or more hours beyond the end of his normal work day, he will be paid an additional forty- five (45) minutes time and one half for his forty-five (45) minute meal period whether he is able to take his meal period or not. If the overtime goes beyond the first four (4) hours, the employee will receive an additional forty-five (45) minutes time and one half for every four (4) hours of overtime worked whether he is able to take his meal period or not. Any employee who is called back to work on the same day after having completed his assigned work and left his place of employment and before his next regular scheduled starting time, will receive an additional forty-five (45) minutes time and one half for every four (4) hours of overtime worked whether he is able to take his meal period or not. This clause will not be used by Management to unreasonably deny the employee his right to take his meal period. It is understood by the employees due to extreme emergency situations, the employee may not be able to take his meal period until such time the emergency situation will allow.
