Common use of Overtime Lieu Time Clause in Contracts

Overtime Lieu Time. Where an employee has worked and accumulated approved overtime hours (other than overtime hours related to paid holidays) such employee shall have the option of electing payment at the applicable overtime rate or time off equivalent to the applicable overtime rate (i.e. where the applicable rate is time and one-half (1 ½), the time off shall be at one and one- half (1 ½) times). Where an employee chooses the latter option, such time off must be taken within the succeeding ninety (90) calendar days of the work week in which the overtime was earned or, with the employee’s agreement, within 12 months of that work week.
