Open Space Requirements. The Project currently has an open space dedication deficiency of 0.75 acres for Block B and 0.39 acres for Block C. Under the BSD Zoning Regulations, a fee-in-lieu is required for such deficiencies. In consideration of the significant financial commitments of the Developer under this Agreement, as well as the City’s plans to develop an approximately 12-acre riverfront park immediately adjacent to the site that serves in large part to meet the open space requirements, the City will consider such fee-in-lieu satisfied.

Open Space Requirements. The property shall be dedicated and maintained in perpetuity as open space for the conservation of natural floodplain functions.

Open Space Requirements. The Northeast Wharf Plaza project is subject to the requirements of the San Francisco Bay Conservation and Development Commission (BCDC) Special Area Plan. Initial site plan studies prepared for the Port include alternate approaches to compliance with this regulatory requirement. Port staff has selected a Northeast Wharf Plaza site configuration that is consistent with the Special Area Plan, but further evaluation and approval by BCDC is needed. Site planning to ensure the complementary uses of the Cruise Terminal and Plaza will continue, leading to consideration of a BCDC Major Permit.

  • Maintenance Requirements The Sub-Adviser shall maintain such books and records with respect to the Allocated Portion as are required by law, including, without limitation, the 1940 Act (including, without limitation, the investment records and ledgers required by Rule 31a-1) and the Advisers Act, and the rules and regulations thereunder (the “Fund’s Books and Records”). The Sub-Adviser agrees that the Fund’s Books and Records are the Fund’s property and further agrees to surrender promptly to the Trust or the Adviser the Fund’s Books and Records upon the request of the Board or the Adviser; provided, however, that the Sub-Adviser may retain copies of the Fund’s Books and Records at its own cost. The Sub-Adviser shall make the Fund’s Books and Records available for inspection and use by the SEC and other regulatory authorities having authority over the Fund, the Trust, the Adviser or any person retained by the Board at all reasonable times. Where applicable, the Fund’s Books and Records shall be maintained by the Sub-Adviser for the periods and in the places required by Rule 31a-2 under the 1940 Act. In the event of the termination of this Agreement, the Fund’s Books and Records will be returned to the Trust or the Adviser. The Adviser and Fund’s Chief Compliance Officer shall, upon reasonable advance notice, be provided with access to the Sub-Adviser’s documentation and records relating to the Fund and copies of such documentation and records.

  • Overtime requirements No contractor or subcontractor contracting for any part of the contract work which may require or involve the employment of laborers or mechanics shall require or permit any such laborer or mechanic in any workweek in which he or she is employed on such work to work in excess of forty hours in such workweek unless such laborer or mechanic receives compensation at a rate not less than one and one-half times the basic rate of pay for all hours worked in excess of forty hours in such workweek.

  • Time Requirements The Independent Contractor will not be required to follow or establish a regular or daily work schedule, but shall devote during the term of this Agreement the time, energy and skill as necessary to perform the services of this engagement and shall, periodically or at any time upon the request of the Company, submit information as to the amount of time worked and scope of work performed.

The Career Education requirement for this Contract is 0 hours. Failure to achieve these requirements may result in the application of some or all of the sanctions set forth in Administrative Policy 3.10, which is hereby incorporated by reference.
