No Virus. Licensee warrants that (i) the applications, interfaces, value-added services and/or solutions, workflows or processes Licensee develops using this SDK will not contain any computer program file that includes time code limitations, disabling devices, or any other mechanism which will prevent the Supplier Software from being functional at all times (collectively “Time Bombs”); and (ii) the applications, interfaces, value-added services and/or solutions, workflows or processes Licensee develops using this SDK will be free of computer viruses, black boxes, malware, trapdoors, and other mechanisms to allow remote/hidden attacks or access through unauthorized computerized command and control, and will not contain any other computer software routines designed to spy, monitor traffic (network sniffers, keyloggers), damage or erase such applications, interfaces, value-added services and/or solutions, workflows or processes developed using this SDK or data, or any computer files or systems of Avaya, its Affiliates, and/or end users (collectively “Virus”). In addition to any other remedies permitted in the Agreement, if Licensee breaches its warranties under this Section, Licensee will, at its expense, take remedial action to eliminate any Time Bombs and/or Viruses and prevent re-occurrence (including implementing appropriate processes to prevent further occurrences) as well as provide prompt, reasonable assistance to Avaya to materially reduce the effects of the Time Bomb and/or Virus.

No Virus. Supplier has taken reasonable steps to test the Supplier Product for programming devices (e.g., viruses, key locks (including, without limitation, that control the number of users), backdoors, etc.) that would (i) disrupt the use of the Supplier Product or any system, device or software to which the Supplier Product is interfaced or other computer equipment with which such equipment communicates; (ii) destroy or damage data or make data inaccessible or delayed, except for file and purge routines necessary to the routine functioning of the Supplier Product; or (iii) permit Supplier personnel, agents or subcontractors access to any portion of the Supplier Product other than as necessary to carry out the terms of this Agreement. Supplier agrees to use programming practices and security procedures to avoid insertion of such devices and to scan for viruses before sending any media containing programming code to Customer.
No Virus. Contractor represents and warrants that (i) it shall ensure that no Viruses are coded or introduced into the Work; (ii) it shall not introduce into the Work any code that would have the effect of disabling or otherwise shutting down all or any portion of the Work; and (iii) it shall not develop, or seek to gain access to the Work through, any special programming devices or methods, including trapdoors or backdoors, to bypass any MSV security measures protecting the Work. If a Virus is present in the Ground Segment at Acceptance, or upon delivery of an update or item replaced during the warranty period, or at any time during the Initial Operations Period, Contractor shall remove the Virus, assist MSV in reducing the effects of the Virus, and assist MSV with mitigating and restoring any such losses of operational efficiency or data that arise as a result of Virus, all at Contractor’s expense. In no event shall Contractor invoke any disabling code at any time, including upon expiration or termination of the Contract (in whole or in part) for any reason, without MSV’s prior written consent.

No Virus. The software licensed hereunder does not and will not contain any virus or other malicious code and will not introduce any virus or other malicious code into your computing environment.
No Virus. No Portion of the Products shall knowingly contain, at the time of delivery, any “back door,” “time bomb,” “Trojan horse,” “worm,” “drop dead device” or other computer software routines or hardware components designed to (i) permit unauthorized access to, or use of, the Products or computer systems on which the Products is loaded, (ii) disable, damage or erase Products or data or (iii) perform any other similar actions that would preclude full use of the Products by Licensee or its sublicensees. In addition, CIC shall use reasonable commercial efforts to ensure that the Products do not contain a virus at the time of delivery. If a virus is discovered, CIC will use reasonable commercial efforts to correct the problem or provide a patch, work around or any other method to eradicate the problem within thirty (30) days following notice by Licensee, at no cost to Licensee.
No Virus. Contractor warrants that no code, device or routine (including, without limitation, time bombs, back doors or drop dead devices) that would have the effect of disabling or otherwise shutting down all or any portion of any software comprising any portion of any Deliverable (“Viruses”) is coded or introduced into any Deliverable any time prior to Final Acceptance (unless Customers expressly authorize the inclusion of a disabling code). If a Virus is present in any portion of any Deliverable prior to or during the Warranty Period and it is determined that the introduction of the Virus was attributable to Contractor, Contractor shall use reasonable efforts to assist Customers in removing or reducing the effects of the Virus, and to assist Customers with mitigating any such losses of operational efficiency or data that arise as a result of the Virus. This constitutes Contractor’s sole obligation and Customers’ sole remedy in the event of Viruses in any Product Deliverables during the Warranty Period. In no event shall Contractor invoke any Virus or disabling code at any time, including upon expiration or termination of the Contract (in whole or in part) for any reason, without Customers’ prior written consent.
