New Construction/Development. In the case of new construction or property development where utilities are to be placed aerially or underground, or of the installation of conduit for the location of utilities, the utility, the developer or the property owner shall give Franchisee reasonable notice of not less than sixty (60) days prior to such construction for development, and, if applicable, of the particular date on which open trenching will be available for Franchisee installation of conduit, pedestals and / or vaults, and materials to be provided at Franchisee’s expense, or as otherwise agreed by the parties. The Franchising Authority, or its designee, shall exercise reasonable efforts to have the Planning Board and developers give timely written notice to Franchisee of trenching and underground construction. Franchisee shall also provide specifications as needed for trenching. Cost of trenching and easements required to bring service to the development shall be borne by the developer or property owner. Service shall be made available to newly constructed areas within three (3) months of completion, taking into account as subject to permitting requirements, weather, force majeure, performance of make ready, and the ability to obtain all necessary easements at no cost to the Franchisee.

New Construction/Development. Where a Participating Landowner undertakes new construction (construction commenced after December 6, 2009) on a Parcel in the Long Creek Watershed that is required to meet the Chapter 500 Requirements in effect at the time that DEP accepts the application for the same as complete for processing and meets the same, as determined by DEP, upon substantial completion of the BMP, that Participating Landowner shall receive a credit of up to 100% of the Participating Landowner’s share of Construction and Maintenance Costs for that Parcel or portion thereof served by the BMP, so long as that BMP is not constructed or installed with District funds.

  • BUILDER’S RISK FOR NEW CONSTRUCTION PROJECTS If the project is NEW CONSTRUCTION, then the following provisions apply:

  • Design and Construction In complying with the requirements of the specification both with respect to arrangement and detail, design is to conform to the best current engineering practice. Each of the several parts of the material is to be of the maker’s standard design provided that this design is in general accordance with the specification. The essence of design should be simplicity and reliability in order to give long continuous service with high economy and low maintenance cost. Particular attention should be paid to internal and external access in order to facilitate inspection, cleaning and maintenance. The design dimensions and materials of all parts are to be such that they will not suffer damage as a result of stresses under the most severe conditions. Fully detailed specifications of the several parts of the material are to be submitted describing particularly the materials to be used. The materials used in the construction of the material are to be of the highest quality and selected particularly to meet the duties required of them. Mechanisms are to be constructed to avoid sticking due to rust or corrosion. Workmanship and general finish are to be of the highest class throughout. All similar parts of the material are to be interchangeable. All equipment is to operate without undue vibration and with the least possible amount of noise and is not to cause a nuisance. All equipment is to be designed to minimize the risk of fire and any damage, which may be caused in the event of fire. The equipment is also to be designed to prevent ingress of all vermin, accidental contact with live parts and to minimize the ingress of dust and dirt. The use of materials, which may be liable to attack by termites or other insects, is to be avoided.

  • Completion of Development Upon the completion of the whole development or complete phases of the development, Council may review this Agreement, in whole or in part, and may:
