Manufacture and Sale. ENZO or its designee shall manufacture, sell and deliver to CIL and CIL shall purchase exclusively from ENZO (after the MANUFACTURING TRANSITION PERIOD with respect to each GROUP A PRODUCT) such quantities of the GROUP A PRODUCTS as CIL may order in accordance with this Agreement. CIL shall have the right to sell GROUP A PRODUCTS worldwide within the scope of this Agreement.
Manufacture and Sale. Upon and subject to the terms and conditions contained herein and during the Term of this Agreement, Seller shall, and/or shall cause Seller’s Affiliates to, Manufacture, sell and deliver Products to Buyer, and Buyer shall purchase and take delivery of Products from Seller or Seller’s Affiliates. Seller shall, and/or shall cause Seller’s Affiliates to, Manufacture, sell and deliver Products hereunder in accordance with (i) the Product Specifications; (ii) cGMP; and (iii) the Act and all other applicable Regulatory Requirements.
Manufacture and Sale. On the terms and conditions of this Article 7, Halozyme shall manufacture (or have manufactured), sell and deliver to Intrexon all API required by Intrexon, its sublicensees and their respective Affiliates for use in the preclinical development, clinical development and commercialization of the Products, and Intrexon shall purchase from Halozyme all quantities of API required by Intrexon, its sublicensees and their respective Affiliates for use in the preclinical development, clinical development and commercialization of the Products. Intrexon, its sublicensees and their respective Affiliates shall use such API supplied by Halozyme solely for the development, manufacture and commercialization of Products pursuant to this Agreement.
Manufacture and Sale. On the terms and subject to the conditions of this Article 6, Gen-Probe shall manufacture, or have manufactured, sell and deliver to Chiron, and Chiron shall purchase from Gen-Probe, such amounts of the Products, as Chiron orders pursuant to Section 6.3.4
Manufacture and Sale. Diamond agrees to manufacture and sell to Distributor, and Distributor agrees to purchase from Diamond, Products and additional products as referenced herein for distribution in the Territory pursuant to and in accordance with the terms and conditions of this Agreement.

On the terms and conditions of this Section 6, Halozyme shall manufacture (or have manufactured), sell and deliver to Bxxxxx all API required by Bxxxxx, its sublicensees and their respective Affiliates for use in Products. Bxxxxx shall purchase from Halozyme all quantities of API required by Bxxxxx, its sublicensees and their respective Affiliates for use in Products. Bxxxxx, its sublicensees and their respective Affiliates shall use API solely for the development, manufacture and commercialization of Products pursuant to this Agreement.

ViroPharma, its sublicensees and their respective Affiliates shall use such API supplied by Halozyme solely for the development, manufacture and commercialization of Products pursuant to this Agreement.

Manufacture and Sale. Licensee shall use its best efforts to further the production and sale of Products under the Trademarks in the Territory and to maintain an efficient organization for the production and sale of high quality Products under the Trademarks. Subject to the provisions of Section 4 hereof, the manufacture, pricing, sale and promotion of Products under the Trademarks shall be controlled by the Licensee.
