Promotion of Products. Following the Acceptance Date, Purchaser shall develop a market and promote the sale of the Products actively, and advertise with a program of advertising to create awareness of Enova products and their associated value proposition. Such promotion and advertising may include, but is not limited to, participation in trade shows, presentations at seminars or industry meetings, direct mailings to key customer groups and market segments, direct sales calls, and other appropriate means. Enova reserves the right to review and disapprove all advertising that contains Enova's name or products as to form and substance. Purchaser shall deliver to Enova prior to its use a copy (translated into English if the original is not in English) of any advertisement, promotion, trademark listing, or display with respect to Enova products, and Enova shall have the right to review and approve or disapprove the form and substance of each.

Promotion of Products a. Promotion Rights in the Exclusive Territory. JT shall have the exclusive responsibility for promoting each Product in the JT Territory. Tularik shall have the exclusive responsibility for promoting each: (A) Product based on a [ * ] Lead Compound in the Tularik Territory; and (B) Product based on a [ * ] in the Tularik Territory prior to [ * ]. All information and materials generated by a Party in the course of the promotion effort within any country in such Party's Exclusive Territory or in the Co-Promotion Territory shall be provided to the MC for use in the promotion effort within the other Party's Exclusive Territory and in the Co-Promotion Territory.

Claims Claims for shortages or errors in packaging must be made to Kaba Mas in writing within ten (10) business days after receipt of shipment. Returned Merchandise Returns will not be accepted without prior written approval by Xxxx Xxx and without a Returned Goods Authorization Number issued by Xxxx Xxx’ Customer Service Department. All returns are subject to a restocking charge. Purchaser must provide invoice number and information regarding original date of shipment with all returned goods. Electronic components sold under the Parts Program are not returnable under any circumstances.

Reseller will promptly establish and maintain during the Term an adequate number of full-time salespersons, installers and service technicians, duly trained and competent in such work, so that the marketing, installation and service of the Products will be at all times of the highest standard. During the Term, Reseller will at all times adhere to any then-current BluBØX Certification Programs and Reseller Program Guides both of which shall be commercially reasonable.

Reseller will pay all costs and expenses by Reseller in connection with the fulfillment of its obligations hereunder, including but not limited to commissions or payments made to sales representatives or employees of Reseller and any expenses incurred in connection with the fulfillment of such obligations. Reseller will purchase, resell, license, distribute, install and service the Products in its own name and on its own behalf and will operate its business at its own risk. Reseller will not be and will not hold itself out in any manner whatsoever, as an agent of BluBØX.
Promotion of Products. (a) BFA Holder agrees to diligently promote and cause its Franchise Dealers to diligently promote the sale of Products, including through advertisements, all in accordance with the terms of this Agreement. BFA Holder hereby acknowledges and agrees that, notwithstanding anything set forth herein to the contrary, to insure the integrity of ExxonMobil trademarks, products and reputation, ExxonMobil shall have the authority to review and approve, in its sole discretion, all forms of advertising and sales promotions that will use media vehicles for the promotion and sale of any product, merchandise or services, in each case that (i) uses or incorporates any Proprietary Xxxx or (ii) relates to any Business operated at a BFA Holder Branded Outlet. Furthermore, for any significant advertising campaign, sponsorship and/or promotion, BFA Holder shall submit in advance to ExxonMobil or its designee, for its written approval, all materials prepared by or for BFA Holder. These materials may include, but are not limited to, any media (including TV, radio, internet or print), professional or collegiate sports affiliations, and cultural or civic sponsorships that would have regional or national reach and are associated with any ExxonMobil brand, whether directly or indirectly. Approval will be granted (or not) within ten (10) business days from ExxonMobil’s receipt of a request from BFA Holder. If no written approval is received from ExxonMobil within the applicable ten-business-day period, then the request shall be deemed denied. BFA Holder shall expressly require all Franchise Dealers to (a) agree to such review and control by ExxonMobil and (b) comply with the notice requirements set forth in this Section. BFA Holder shall be responsible for compliance (both by BFA Holder and by its Franchise Dealers) with any and all applicable federal, state, county or local advertising laws, statutes, ordinances, codes, regulations, rules, orders, or permits.
Promotion of Products. Contractor agrees to use its best efforts to implement, incorporate and otherwise use the Products in its provision of Contractor Services to Customers, including, without limitation, including a link to Xxxx'x website at [xxx.xxxxxxxxxxx.xxx] on any website maintained or controlled by Contractor. In the event that Contractor is not in compliance with the foregoing, Xxxx'x reserves the right to suspend or terminate Contractor’s inclusion in the Referral Pool.
