Jury Duty/Court Leave. A. A teacher required to appear as a witness at a trial or hearing before a court of competent jurisdiction shall be granted leave with pay if called as a witness to testify to facts arising out of such teacher’s scope of employment. A teacher required to appear as a defendant or appearing as a witness at the request of the Board at a trial or hearing before a court of competent jurisdiction shall be granted leave with pay if named as a defendant by reason of acts or omissions arising from such teacher’s scope of employment. Additional days as needed may be granted for consultation with legal counsel. Scope of employment is defined as those acts that arise during the performance of teaching duties. Scope of employment is not to be construed to include cases arising out of contract disputes between a teacher and the Board or the Association and the Board. The leave granted under this provision shall not be deducted from such teacher’s sick leave or personal leave. Leave with pay under this article will not be granted if a teacher is to appear in court in a personal legal matter.
