INDEPENDENT AGENCY. 8.1 It is understood and agreed that RECIPIENT’S status in relation to COUNTY is that of an independent agent; and the RECIPIENT’S acts, made through any of RECIPIENT’S officers, agents, or employees are made without any suggestion, direction, or management whatsoever by the COUNTY, the COUNTY’S Representatives, or any other of COUNTY’S officers, agents, or employees. The parties agree that the Funds provided to RECIPIENT under this Agreement do not give COUNTY any authority whatsoever over the manner and method by which RECIPIENT carries out its purposes. However, to the extent that any actions taken by RECIPIENT violate the understanding between the parties, as expressed in RECIPIENT’S application for Funds and in this Agreement, COUNTY shall have the rights provided it under this Agreement to withdraw funding and demand reimbursement of Funds previously expended by RECIPIENT.
INDEPENDENT AGENCY. RECIPIENT performs the terms and conditions of this AGREEMENT as an entity independent of TAM. None of RECIPIENT'S agents or employees shall be agents or employees of TAM.
INDEPENDENT AGENCY. The Agency shall perform the conditions of its Agreement as an independent Agency with all licensure, as appropriate, and nothing contained herein shall be construed to be inconsistent with this relationship or status.
INDEPENDENT AGENCY. An office, commission, board, department, or agency of State government established by statute as an independent unit of government and not part of a cabinet secretariat or other principal unit.
INDEPENDENT AGENCY a) It is the intention that the Agency shall have independent contractor status and not be an employee for any purpose, including, but not limited to, the application of the Federal Insurance Contribution Act, the Social Security Act, the Federal Unemployment Tax Act, the provisions of the Internal Revenue Code, the California State Revenue and Taxation Code relating to withholding at the source of income, Workers’ Compensation Insurance, 401K plans, and other benefit payments and their liability claims. Agency shall retain sole and absolute discretion in the manner and means of carrying out its activities and responsibilities under this Agreement. This Agreement shall not be considered or construed to be a partnership or joint venture, and the Client shall not be liable for any obligations incurred by Agency unless specifically authorized in writing.
INDEPENDENT AGENCY. The parties agree that the relationship between the County and the Agency that is established by this Agreement is that of independent contractors. Nothing in this Agreement shall be construed to create any employment relationship between the County or any of its employees and the Agency or any of its employees. Neither party shall have any right, power or authority to assume, create or incur any expense, liability or obligation, express or implied, on behalf of the other.
INDEPENDENT AGENCY. TOWN performs the terms and conditions of this AGREEMENT as an entity independent of DISTRICT. TOWN'S agents or employees shall not be agents or employees of DISTRICT. The TOWN is acting in an independent capacity and is solely responsible for the PROJECT. Review or approval of all PROJECT-related documents by TOWN is solely for the purpose of proper administration of funds by DISTRICT and shall not be deemed to relieve or restrict DISTRICT’s responsibility for the preparation, submission, management, or control of the PROJECT.
INDEPENDENT AGENCY. The continued growth and extensive development within the incorporated and unincorporated areas of Stanislaus County evidenced a need to create a wholly independent regional agency capable of dealing with area-wide issues and problems.
INDEPENDENT AGENCY. Sponsor renders its services under this Agreement as an independent agency and TAMC is also an independent agency under the Agreement. None of the Sponsor's agents or employees shall be agents or employees of TAMC and none of TAMC’s agents or employees shall be agents or employees of Sponsor.
INDEPENDENT AGENCY. 5.1 It is understood and agreed that Bakcou’s status in relation to County is that of an independent contractor; and Bakcou’s acts, made through any of Bakcou’s officers, agents or employees are made without any suggestion, direction, or management whatsoever by the County, the County Representatives, or any other of County’s officers, agents or employees.
