General Administration of Construction Contract. Consult with Owner and act as Owner’s representative as provided in the Construction Contract. The extent and limitations of the duties, responsibilities, and authority of Engineer shall be as assigned below. All of Owner’s instructions to Contractor will be issued through Engineer, which shall have authority to act on behalf of Owner in dealings with Contractor to the extent provided in this Agreement and the Construction Contract except as otherwise provided in writing.

The extent and limitations of the duties, responsibilities, and authority of Engineer shall be as assigned in EJCDC® C-700, Standard General Conditions of the Construction Contract (2013 Edition), prepared by the Engineers Joint Contract Documents Committee, or other construction general conditions specified in this Agreement. If Owner, or Owner and Contractor, modify the duties, responsibilities, and authority of Engineer in the Construction Contract, or modify other terms of the Construction Contract having a direct bearing on Engineer, then Owner shall compensate Engineer for any related increases in the cost to provide Construction Phase services. Engineer shall not be required to furnish or perform services contrary to Engineer’s responsibilities as a licensed professional. All of Owner’s instructions to Contractor will be issued through Engineer, which shall have authority to act on behalf of Owner in dealings with Contractor to the extent provided in this Agreement and the Construction Contract except as otherwise provided in writing.

General Administration of Construction Contract. Web-based Project Management Systems ARCHITECT will, in collaboration with DISTRICT, ARCHITECT’s consultants, and the Contractor, use ARCHITECT’s web-based Project management software system to administer the construction phase of the PROJECT. This will include the processing, distributing, implementing, and collaborating of all items described in Article 1.5 and Project documentation to include, but not limited to, Specification and Drawings, Requests for Information, submittals, meeting minutes, change order proposals, change orders, payment requests, field direction, Architectural Supplemental Information, etc. The ARCHITECT shall provide all required training and software program access for the DISTRICT Construction Manager, FISCAL Services Representatives, and other designated DISTRICT representatives as determined by the DISTRICT. Architect shall consult with and advise District and act as District’s representative as provided in Document 00 72 00 General Conditions and Division 01 Specifications (herein called the “General Conditions”). Architect shall review the General Conditions prior to award of the Construction Agreement, and shall perform all duties which the General Conditions provide will be performed by the “Architect” or “Architect/Engineer”. Architect will have authority to act on behalf of District to the extent provided in the General Conditions of the Construction Contract, provided, however, that District may, in its sole discretion, issue instructions directly to Contractor if notice of such instructions is given to Architect as soon as practicable thereafter. Architect will work with District, Project Manager, and any other Project Inspectors, testing agencies, and governmental agencies as set forth in the General Conditions and this Contract. Architect consents to District’s retaining of a construction manager who may perform some or all of the functions assigned to Project Manager in this Agreement.
