Gas Interconnection. (a) Xxxxxxxx shall be responsible for the construction of all Natural Gas Interconnection Facilities necessary for delivery of Natural Gas up to and including the Natural Gas Delivery Point (including the Natural Gas Metering Equipment but excluding compressors ("Natural Gas Interconnection Facilities")) and shall use all commercially reasonable efforts to expeditiously construct or contract for the expeditious construction of such Natural Gas Interconnection Facilities in order to make Natural Gas available to Seller at the Natural Gas Delivery Point no later than [*] prior to the Anticipated Commercial Operation Date. In the event that such Natural Gas Interconnection Facilities have not been constructed and/or Xxxxxxxx is unable for any reason to deliver Natural Gas to the Facility by the date that the Facility would otherwise be prepared to begin Initial Start-Up Testing, but in no event prior to the date Scheduled therefor, (the "Start-Up Testing Date"), and but for the failure to provide such Natural Gas the Facility is otherwise ready, or would otherwise have been ready, to begin such testing (as reasonably determined by a Third Party Engineer chosen in accordance with the provisions of this Agreement), then [*].

  • Interconnection If Manager desires to interconnect a portion of the Service Area Network with another carrier and Sprint PCS can interconnect with that carrier at a lower rate, then to the extent permitted by applicable laws, tariffs and contracts, Sprint PCS may arrange for the interconnection under its agreements with the carrier and if it does so, Sprint PCS will xxxx the interconnection fees to Manager.

  • Metering 1. If the Producer desires to sell electric power to the Company, the Company shall provide, own and maintain at the Producer's expense all necessary meters and associated equipment to be utilized for the measurement of energy and capacity for determining the Company's payment to the Producer pursuant to an applicable agreement.

  • Plant An electrical generating alternative energy resource facility developed by Producer for which IID shall provide transmission service, as specified in Exhibit(s) II, Transmission Service, and in any subsequent Plant Amendments.

  • Delivery Point Once Manufacture of the Products has been completed, Contractor shall be responsible for delivering the Finished Goods FCA, (as defined in Incoterms (2000) published by the International Chamber of Commerce) and to a freight forwarder specified by Company in its Order, or otherwise approved by Company. “Delivery Point” as used in this Agreement shall mean the specific time and location that the Product is delivered to the shipper specified on the Order.

  • Gas Contracts No Credit Party, as of the date hereof or as disclosed to the Administrative Agent in writing, (a) is obligated in any material respect by virtue of any prepayment made under any contract containing a “take-or-pay” or “prepayment” provision or under any similar agreement to deliver Hydrocarbons produced from or allocated to any of the Borrower’s and its Subsidiaries’ Oil and Gas Properties at some future date without receiving full payment therefor at the time of delivery or (b) except as has been disclosed to the Administrative Agent, has produced gas, in any material amount, subject to balancing rights of third parties or subject to balancing duties under Legal Requirements.

  • ELECTRICAL SERVICES A. Landlord shall provide electric power for a combined load of 3.0 xxxxx per square foot of useable area for lighting and for office machines through standard receptacles for the typical office space.
