Discharge for Failure to Meet Association Membership Requirements. Failure by an employee to abide by the above provisions shall constitute cause for discharge for such employee provided, however, that when an employee fails to fulfill the above obligation, the Association shall provide the District with thirty (30) days notification of the Association's intent of discharge action, and during this period the employee may make restitution in the amount which is overdue.

Discharge for Failure to Meet Association Membership Requirements. Failure 6 by an employee to abide by the above provisions shall constitute cause for discharge of such employee; 7 provided that when an employee fails to fulfill the above obligation, the Association shall provide the 8 employee and the County with thirty (30) days’ written notification of the Association’s intent to 9 initiate discharge action, and during this period the employee may make restitution in the amount 10 which is overdue. 11 If the employee has not fulfilled the above obligation by the end of the Association’s thirty (30) 12 calendar day discharge notification period, the Association will thereafter notify the Human Resources 13 Director of the Department of Executive Services in writing, with a copy to the Department Director 14 and the employee of such employee’s failure to abide by Article 3 as applicable. In this notice the 15 Association will specifically request discharge of the employee for failure to abide by the terms of the 16 labor agreement between the County and the Association. The Association will indemnify, defend, 17 and hold the County harmless against any claims made and against any suit instituted against the 18 County arising out of action taken or not taken by or on behalf of the County under the provisions of 19 this Article.
