Data Use Restrictions. Use of the Licensed Dataset by the Data Users shall be governed by the following provisions:
Data Use Restrictions. Client agrees that it will not, either directly or indirectly, itself or through any agent or third party, without the prior written consent of Experian, request, compile, store, maintain, resell or use the Services (including any of the information contained in the Services) to build its own credit reporting database. Client shall be solely responsible for assuring the secure and confidential manner in which it stores, delivers and transmits Services to its authorized employee users. Client shall, at a minimum, comply with Experian’s standard access security requirements.
Data Use Restrictions. 2.1. In accessing the Product provided via e-Markets Portal, You agree that You will not, without the prior written consent of the Company, sell, licence, sub-licence, distribute, lease, or otherwise transfer or allow the transfer of the Product, or any backup copy, to third parties, or use the product in any manner inconsistent with the rights granted by way of the aforesaid access. Where the Product is disseminated, or used in a manner that is prohibited, the Company reserves the right to penalise You for non-compliance.
Data Use Restrictions. Customer will use the Ekata Data for identity verification and fraud detection and prevention use cases only, and will not: (a) use the Ekata Data for marketing purposes; (b) use the Ekata Data in violation of any applicable law, rule, or regulation or in violation of any third-party right; (c) store the Ekata Data for purposes other than Customer’s own internal business purposes; (d) use the Ekata Data in conjunction with illicit activities; (e) store or cache the Ekata Data to avoid making additional queries to the Services; (f) merge stored Ekata Data with other data unless it is coded or tagged to indicate Ekata as its source; or (g) use the Ekata Data for file download in a fixed page format (i.e., create a printable, downloadable directory of personal information). You acknowledge that the Service is not provided by a “consumer reporting agency” as that term is defined in the Fair Credit Reporting Act (“FCRA”) and the Ekata Data do not constitute “consumer reports” as defined in the FCRA. Accordingly, the Ekata Data may not be used as a factor in determining eligibility for credit, insurance, employment or any other purpose in which a consumer report may be used under the FCRA (or any similar consumer credit law in the United States of America or otherwise).
Data Use Restrictions. Supplier agrees that it shall not access, use, or disseminate any data or information provided by Anthem, in whatever form, for any purpose other than the performance of Supplier’s obligations under this Agreement. Notwithstanding the foregoing, Anthem acknowledges and agrees that, to the extent permitted by applicable law, Supplier may for the Permitted Purposes defined below collect, create, use, aggregate, and disclose (i) digital usage and performance data with respect to the use and performance of the Vendor Services that does not identify Members or Anthem and (ii) de-identified data about Members collected or generated by the Vendor Services as long as such data is devoid of any information that identifies Members or Anthem, or with regard to which there is a reasonable basis to believe that the information could be used to identify individuals. "Permitted Purposes" means (i) for statistical and marketing analysis, (ii) to analyze use of the Vendor services, (iii) to improve efficiency and service tools for the use of the Services, and to analyze how Vendor might improve the Vendor Services; (iv) for secondary research or clinical audit purposes, and (v) and for its internal business purposes provided they are consistent with the terms of this Agreement.
