CONTRACT LIMIT AND FEES AND EXPENSES to change the not-to- exceed total amount of the Contract from SIX HUNDRED THOUSAND DOLLARS AND NO CENTS ($600,000.00) to ONE MILLION DOLLARS AND NO CENTS ($1,000,000.00) through the end of the first renewal term of the Contract, as approved by RRC Commissioners on September 18, 2018.

The total amount of fees to be paid by RRC to Contractor under the Contract through the Contract Term shall not exceed ONE MILLION FIFTY THOUSAND DOLLARS AND ZERO CENTS ($1,050,000.00), the total of which includes the current NTE amount of SIX HUNDRED AND FIFTY THOUSAND DOLLARS AND ZERO CENTS ($650,000.00), as approved by RRC Commissioners on September 1, 2020, plus the addition of FOUR HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($400,000.00), as approved by RRC Commissioners on August 24, 2021.” Except as expressly amended above, all provisions of the Contract, as amended, remain in full force and effect. In the event of a conflict among provisions of the Contract, the order of precedence shall be: this Amendment No. 1; and then the original Contract in accordance with section 1.03. (a) During the renewal period commencing September 1, 2021, and terminating on August 31, 2023, the total amount of this renewal Contract shall not exceed the sum $2,006,960.00. This amount includes a Base Contract Amount and a not-to-exceed amount to cover any Additional Services, as defined in Section 3.3, and as set forth in Table 1, indicating costs for services on properties subject to House Bill 3042 (“HB 3042”), and costs for services provided for Non-House Bill 3042 (“Non-HB 3042”) properties.
