COMMENCEMENT OF ANNUAL ASSESSMENTS. The assessments provided for herein shall commence as to each Burdened Lot on the first day of the month following the recordation of this Covenant. During the calendar year following the recordation of this Covenant, the Board shall fix the amount of the annual assessment against each Burdened Lot within thirty (30) days of the annual meeting of the Members; but in the absence of such action by resolution of the Board of Directors, the assessments shall be in the amount last fixed. Written notice of the annual assessment shall be sent to every Member on an annual basis. The assessments shall be paid as set by the Board. The due date of the assessments may be established by resolution of the Board of Directors. The Association shall, upon demand at any time, furnish a certificate in writing signed by an officer of the Association setting forth whether the assessments on a specified Burdened Lot have been paid. A reasonable charge may be made by the Board for the issuance of these certificates. Such certificate shall be conclusive evidence of payment of any assessment therein stated to have been paid.

COMMENCEMENT OF ANNUAL ASSESSMENTS. The first annual assessment shall become due and payable on the first day of the month following the lapse of thirty (30) days from the date of the sale of the first Lot in the Subdivision. Thereafter as each person or entity becomes a member such new Members' assessment for the current year shall be a pro-rata part of the annual assessment and shall be due on the first day of the month following the date such person or entity becomes a Member of the Association. Upon a person or entity's ceasing to be a Member of the Association, such Member shall not be entitled to any refund of his annual assessment. It shall be the duty of the Board of Directors to notify each owner of any change in the annual assessment or any special assessment and the due date of such assessment. Any assessment not paid within ten (10) days after the due date (the first day after such ten (10) day period shall be referred to as the “delinquency date”) shall be delinquent. The requirement of notice shall be satisfied if such notice is given by regular deposit in the United States Mail to the last known address of each such owner. The due date of any special assessment under Section 4.4 hereof shall be fixed in the resolution authorizing such assessment.
COMMENCEMENT OF ANNUAL ASSESSMENTS. Each Owner shall pay its first Annual Assessment upon the closing of the purchase of its Lot, adjusted according to the number of months remaining in the Assessment Year. Thereafter, annual Assessments shall be paid as herein provided herein. In addition to the foregoing, each Owner purchasing a Lot from the Declarant or a Builder shall pay an initial set-up fee to be deposited with the Association and which shall be in xxxxxx amount asdetermined by Declarant shall determine, but which shallmust be uniform for all Lot Owners. Under no circumstances will more than $200.00 of each Owner’s Annual Assessment be used for repayment of the Amenities Note.
